In accordance with the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management (‘the Joint Convention’) and the International Atomic Energy Agency (IAEA) Code of Conduct on the Safety and Security of Radioactive Sources, and current industrial practices, disused sealed sources can be reused, recycled or disposed of.

It needs, nevertheless, to be amended in the light of experience in order to clarify and add concepts and definitions, to address situations that had been omitted in the past, to simplify the existing procedure for the shipment of radioactive waste between Member States and to guarantee consistency with other Community and international provisions, and in particular with the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management (hereinafter referred to as Joint Convention), to which the Community acceded on 2 January 2006.

When an arrangement between a consignee in a third country and a holder in a third country has been concluded pursuant to Article 27 of the Joint Convention, the same arrangement could be used for the purpose of this Directive.

When acceding to this Convention the Euratom Community will have to put forward a reservation with regard to the non-compliance of Article 12 of the Directive 92/3/Euratom on the supervision and control of shipments of radioactive waste between Member States and into and out of the Community with the specific requirement in Article 27 of the Joint Convention which requires the consent of the state of destination in the framework of transboundary movements.
La Communauté européenne de l'énergie atomique devra, lorsqu'elle adhérera à cette convention, émettre une réserve concernant la non-conformité de l'article 12 de la directive 92/3/Euratom relative à la surveillance et au contrôle des transferts de déchets radioactifs entre États membres ainsi qu'à l'entrée et à la sortie de la Communauté à l'exigence particulière spécifiée à l'article 27 de la convention commune qui exige le consentement de l'État de destination dans le cadre des mouvements transfrontières.
