K. whereas the ECJ has confirmed that openness and access to information 'contribute to conferring greater legitimacy on the institutions in the eyes of citizens of the Union and increasing their confidence in them by allowing divergences between various points of view to be openly debated. It is in fact rather a lack of information and debate which is capable of giving rise to doubts in the minds of citizens, not only as regards the lawfulness of an isolated act, but also as regards the legitimacy of the decision-making process as a whole' (Joined Cases C-39/05 P and C-52/05 P, paragraph 59),

By application lodged at the Registry of the Court of Justice on 25 April 1997 Kernkraftwerke Lippe-Ems GmbH ('KLE') brought an appeal against the judgment of 25 February 1997 in Joined Cases T-149/94 and T-181/94 Kernkraftwerke Lippe-Ems v Commission ('the contested judgment'), in which the Court of First Instance dismissed its applications for annulment of Commission Decisions 94/95/Euratom of 4 February 1994 and 94/285/Euratom of 21 February 1994, both relating to a proceeding in application of the second paragraph of Article 53 of the Euratom Treaty.
Par requête déposée au greffe de la Cour le 25 avril 1997, la société Kernkraftwerke Lippe-Ems GmbH (ci-après «KLE») a formé un pourvoi contre l'arrêt du Tribunal de première instance du 25 février 1997, Kernkraftwerke Lippe-Ems/Commission (T-149/94 et T-181/94, ci-après l'«arrêt attaqué»), par lequel celui-ci a rejeté ses recours tendant à l'annulation des décisions de la Commission 94/95/Euratom, du 4 février 1994, et 94/285/Euratom, du 21 février 1994, relatives à l'application de l'article 53 deuxième alinéa du traité CEEA.
