I believe that the Commission is right to point out that Article 296 of the Treaty establishing the European Community, which currently represents a constitutional obstacle to the development of what we may call a European defence market, may to a certain extent be overcome on the basis of the judgments of the Court of Justice in recent cases, such as the Johnston case, or the case of the Commission against Spain, of 1997.
Je crois que la Commission a raison de souligner que l’article 296 du traité instituant la Communauté européenne, qui représente actuellement un obstacle constitutionnel au développement de ce que nous pourrions appeler un marché européen de la défense, pourrait être surmonté dans une certaine mesure grâce aux arrêts rendus par la Cour de justice dans des affaires récentes, comme l’affaire Johnston ou l’affaire qui opposait la Commission à l’Espagne en 1997.
