It must be borne in mind that the statement of reasons must be appropriate to the nature of the measure in question and must show clearly and unequivocally the reasoning of the institution which adopted the contested measure so as to inform the persons concerned of the justification for the measure adopted and to enable the competent Community court to exercise its power of review (judgments in Cases C‑289/97 Eridania v Azienda Agricola San Luca di Rumagnoli Viannj [2000] ECR I‑5409, paragraph 38, and C‑340/98 Italy v Council [2002] ECR I‑2663, paragraph 58).

The Commission has decided to refer Italy to the European Court of Justice in three separate cases concerning respectively: the purchase of light helicopters for the Police and the National Fire Brigade; the review procedures relating to the award of public contracts; and the procedure followed by Azienda Casa Emilia Romagna of Reggio Emilia for the award of public works contracts relating to the maintenance and construction of council houses.

The Commission has decided to issue a reasoned opinion against Italy for infringement of the Directive on public supply contracts (93/36/EEC) in connection with the contract for the supply of sterile sutures for operating theatres, radiographic equipment and developing fluids awarded by a Rome hospital (Azienda "Complesso ospedaliero San Filippo Neri"), on the grounds that the contract was awarded by accelerated restricted procedure although the conditions set out in the Directive for use of the accelerated procedure were not fulfilled, since supply of these products should have been possible simply by launching the procedure well before the previous contract expired, on the basis of expected consumption. The previous contract had also been the subject of an infringement procedure, since it had been concluded following a negotiated procedure in infringement of Directive 93/36/EEC and its performance should not have been completed.
La Commission a décidé d'émettre un avis motivé à l'égard de la République italienne pour violation des dispositions de la Directive marchés publics de fournitures (93/36/CEE) en ce qui concerne le contrat pour la fourniture de sutures stériles pour chambres opératoires et matériel radiographique et liquides de développement lancé par un hôpital à Rome (l'Azienda «Complesso ospedaliero San Filippo Neri». Le manquement résulte du fait que le marché a été passé par procédure restreinte accélérée sans que les conditions prévues par la Directive pour l'accélération des procédures soient remplies. En effet, l'approvisionnement de ces produits aurait pu avoir lieu tout simplement en lançant la procédure bien avant l'échéance du contrat précédent, sur la base des consommations prévisibles. De plus, le contrat précédent aussi avait fait l'objet d'une procédure d'infraction. Il avait, en effet, été conclu suite à une procédure négociée en violation de la Directive 93/36/CEE et son exécution n'aurait pas dû être poursuivie jusqu'à la fin.
