Reiterates its call for a full investigation into collaboration by European states in the ‘extraordinary rendition’ programme of the United States and the CIA, flights and secret prisons within the territory of the Union, and insists that Member States must perform effective, impartial, in-depth, independent and transparent investigations and that there is no place for impunity; reminds the Member States that the ban on torture is absolute and, therefore, that state secrecy cannot be invoked to limit the obligation on states to investigate serious human rights violations; stresses that the Member States’ reputation and trust in their commitment to protect fundamental rights will be at stake should they fail to comply with the above;

With regard to the reiterated argument that the recent change in the exchange rate between USD and EUR led to a significant increase in the price of the imported PET and consequently the Union industry allegedly does not need to be granted protection by trade defence measures, it is noted that any anti-subsidy investigation normally does not take into account the post IP developments; unless, in extraordinary situations, it can be shown, inter alia, that they are of a lasting nature and would significantly alter the findings of the case.

Thanks the Chief Prosecutor Javier Zaragoza and Prosecutor Vicente González Mota of the Audiencia Nacional for their testimony to the Temporary Committee and applauds their investigations into the use of Spanish airports for the transit of CIA aircraft within the context of the programme of extraordinary rendition; encourages the prosecutors to investigate further the stopovers of the aircraft involved in the extraordinary rendition of Khaled El-Masri; takes note of the decision by the Spanish authorities, at the request of the Judge of the Audiencia Nacional, to declassify secret documents held by the intelligence services concerning the use by CIA-operated aircraft of Spanish airports;
