The Commission would like to draw the attention of the honourable Member to the fact that it is currently carrying out phase II in-depth investigations into the E.ON/MOL merger in Hungary and the DONG/E2 merger in Denmark.

4. Attaches capital importance to the ambitious legislative review process started with the process for modernisation of anti-trust rules and continued with substantial reforms on merger control, and encourages the Commission to speed up its work towards new streamlined procedures for state aid control, in view of the forthcoming EU enlargement; notes that the Commission's merger control powers are being extended in line with cartel legislation; draws attention to the existence of a fundamental difference between the objectives of merger control and combating cartel infringements, in as much as an investigation into concentrations, as distinct from cartel infringements, does not presuppose the unlawfulness of the objectives pursued by the parties to the merger; asks the Commission to review efforts to strengthen investigating powers in the merger control regulation ; emphasises that the Commission should, in any event, make it clear that it will comply with the generally applicable principles of procedural law in drawing up the procedures, in so far as these are not specified in the regulation itself;

The Committee on Economic and Monetary Affairs has proposed toning down some of the provisions in the proposal for a regulation, given that we believe that, on grounds of proportionality, it is absolutely unnecessary to bring the Commission’s powers of investigation for mergers into line with the powers envisaged for cartels, since the areas concerned are completely different.

As rapporteur on merger control, I have already stated my opinion that it is wrong to force the Commission’s powers of investigation under the Regulation on merger control into line with those pursuant to the Regulations on cartels.
