TRADUCTIONS EN CONTEXTE

An important test case is coming now with the nomination of a new Chief Prosecutor for the Directorate for Investigation of Organised Crime and Terrorism (DIICOT), following the resignation of the Chief Prosecutor in November.[6] The procedure includes a strong political element in terms of the role it gives to the Minister of Justice.[7] The Superior Council of the Magistracy (SCM) is working on an amendment to the law to change this, and to align appointment of prosecutors on the procedures used for judges, in line with the guidance of the European Commission for Democracy through Law of the Council of Europe (Venice Commission):[8] if this were to be pursued, the next step would be for the government to propose this to Parliament.
Un test important se profile à présent, à savoir la nomination d'un nouveau procureur principal au sein de la Direction des enquêtes sur la criminalité organisée et le terrorisme (DIICOT) après la démission du précédent, en novembre dernier[6]. La procédure comporte une forte dimension politique compte tenu du rôle accordé au ministre de la justice[7]. Le Conseil supérieur de la magistrature (CSM) travaille actuellement sur une modification de la loi pour changer cet aspect et aligner la nomination des procureurs sur les procédures en vigueur pour les juges, conformément à ce que préconise la commission européenne pour la démocratie par le droit du Conseil de l'Europe (Commission de Venise)[8]: s'il devait être donné suite à cette proposition, la prochaine étape consisterait, pour le gouvernement, à la transmettre au Parlement.

On reception of that information, the European Chief Prosecutor may within 3 days request the Permanent Chamber to review its decision if the European Chief Prosecutor considers that the interest to ensure the coherence of the investigations and prosecutions of the EPPO so requires.

In particular, Bulgaria needs to address the absence in Bulgarian law of sufficient guarantees for an independent investigation into offences of which the Chief Public Prosecutor or other high-ranking officials close to him may be suspected (ECHR 1108/02 Kolevi, judgment of 05/11/2009, final on 05/02/2010).

After the Amsterdam Treaty entered into force, the European Council of Tampere added a number of important measures to be implemented in the area of police co-operation. The main ones were the establishment of a European police chiefs' operational task force to i.a. contribute to the planning of operative actions; a call to enable Europol to participate in investigation teams and to ask Member States to start investigations; and the establishment of a European Police College for the training of senior police officials.

Among these measures, it is important to underline here better use of existing instruments, such as Europol and Eurojust, or the Framework Decision on Joint Investigation Teams, as well as a strengthened role for the Task Force of Eu Police Chiefs.
