There is as yet no Community legislation in force whereby an invention can be patented in all the Member States on the strength of a single application. However, when, in 1986, the Union cleared the way to complete the internal market, it opted to proceed by approximating the Member States’ economic and monetary laws.
Au niveau communautaire, il n’existe pas encore de réglementation spécifique qui permette, par un seul dépôt, d’obtenir un brevet d’invention valable dans tous les États membres. The proposed Directive is aimed at approximating the legislation of Member States regarding the protection of inventions by the utility model, so as to assist enterprises and independent inventors in the business of exploiting their inventions in several Members States.
L'objectif de la directive proposée serait le rapprochement des législations des Etats membres en matière de protection des inventions par le modèle d'utilité, de manière à faciliter la tâche des entreprises ou des inventeurs indépendants qui veulent exploiter leurs inventions dans plusieurs Etats membres.
