The European Union is establishing Community tax-exemption arrangements for the non-commercial importation of goods by travellers in respect of intra-Community travel and travel between Member States and third countries
L'Union européenne établit des régimes communautaires de franchises fiscales pour les importations non commerciales de marchandises effectuées par des voyageurs dans le cadre du trafic intracommunautaire et du trafic entre les États membres et les pays tiers.

As to the latter point, it should be noted that Denmark and Finland have recently made substantial reductions in their rates on some alcoholic beverages as a consequence of the expiry on 31 December 2003 of their derogations to apply restrictions on the amount of alcohol that intra-Community travellers can bring with them, and in anticipation of the enlargement of the EU on 1 May 2004.
Mais nombreux sont ceux qui insistent pour qu'un effort soit également consenti par les États membres qui appliquent des taux très élevés. En ce qui concerne ce dernier point, il convient de remarquer que le Danemark et la Finlande ont récemment réduit leurs taux sur certaines boissons alcoolisées de façon substantielle, suite à l'expiration au 31 décembre 2003 de leurs dérogations permettant d'appliquer des restrictions à la quantité d'alcools que les voyageurs peuvent introduire et anticipant sur l'élargissement de l'UE au 1er mai 2004.

This Regulation is without prejudice to checks carried out under general police powers and security checks on persons identical to those carried out for domestic flights, to the possibilities for Member States to carry out exceptional checks on baggage in accordance with Council Regulation (EEC) No 3925/91 of 19 December 1991 concerning the elimination of controls and formalities applicable to the cabin and hold baggage of persons taking an intra-Community flight and the baggage of persons making an intra-Community sea crossing , and to national law on carrying travel or identity documents or to the requirement that persons notify the authorities of their presence on the territory of the Member State in question.
Le présent règlement n'a pas d'incidence sur les vérifications effectuées dans le cadre de l'exercice des compétences générales de police, ni sur les contrôles de sûreté sur des personnes, mesures identiques à celles pratiquées pour les vols intérieurs, ni sur les possibilités qu'ont les États membres d'effectuer des contrôles à caractère exceptionnel sur les bagages conformément au règlement (CEE) no 3925/91 du Conseil du 19 décembre 1991 relatif à la suppression des contrôles et formalités applicables aux bagages à main et aux bagages de soute des personnes effectuant un vol intracommunautaire ainsi qu'aux bagages des personnes effectuant une traversée maritime intracommunautaire , ni sur la législation nationale relative au port des documents de voyage et d'identité ou à l'obligation pour les personnes de signaler aux autorités leur présence sur le territoire de l'État membre concerné.

The Commission always recognised that the decision to abolish duty­free sales for intra­Community travellers might have an adverse impact on certain regions.
La Commission a toujours reconnu que la décision de supprimer les ventes hors taxes pour les voyageurs au sein de la Communauté pourrait se répercuter de manière négative sur certaines régions.

It also confirmed this position in its communication of 17 February 1999 to the Council and the European Parliament concerning the employment aspects of the decision to abolish tax- and duty-free sales for intra-Community travellers.
Elle a d’ailleurs confirmé cette position dans le cadre de sa communication du 17 février 1999 au Conseil et au Parlement européen sur les conséquences pour l’emploi de la suppression des ventes hors taxes pour les voyageurs intra-communautaires.

Logic dictates that the Member States draw the consequences of this harmonisation effort and review the need to continue imposing a national obligation on travellers to declare extra- and intra-Community cash movements.
La logique commandant de tirer les conséquences de cet effort d'harmonisation au niveau communautaire, les États membres devront s'interroger sur la nécessité de continuer à imposer aux voyageurs une obligation nationale de déclaration pour les mouvements extracommunautaires et intracommunautaires d'argent liquide.
