IN-CONTEXT TRANSLATIONS

The expiry in June 2010 of the regulatory safeguards which apply to intra-Community voice roaming services at wholesale and retail levels by virtue of Regulation (EC) No 717/2007 would therefore give rise to a significant risk that the underlying lack of competitive pressures in the voice roaming market and the incentive for mobile operators to maximise their roaming revenues would result in retail and wholesale prices for intra-Community roaming that do not constitute a reasonable reflection of the underlying costs involved in the provision of the service, thereby jeopardising the objectives of Regulation (EC) No 717/2007.
Avec l’expiration, en juin 2010, des garanties réglementaires applicables aux tarifs de gros et de détail des services vocaux en itinérance intracommunautaire en vertu du règlement (CE) no 717/2007, le risque serait donc grand que le manque sous-jacent de pressions concurrentielles sur ce marché de services et la tentation des opérateurs de réseau mobile de maximiser leurs recettes d’itinérance ne mènent à une situation où les prix de détail et de gros de l’itinérance intracommunautaire ne refléteraient pas fidèlement les coûts sous-jacents encourus pour la fourniture du service, au détriment des objectifs du règlement (CE) no 717/2007.

“Community-wide roaming” means the use of a mobile telephone or other device by a roaming customer to make or receive intra-Community calls, to send or receive SMS messages, or to use packet switched data communications, while in a Member State other than that in which that customer's home network is located, by means of arrangements between the operator of the home network and the operator of the visited network.
“itinérance communautaire”, l’utilisation d’un téléphone portable ou d’un autre appareil par un abonné itinérant pour passer ou recevoir des appels à l’intérieur de la Communauté, envoyer ou recevoir des SMS ou utiliser des données par commutation de paquets lorsqu’il se trouve dans un État membre autre que celui où est situé son réseau d’origine, du fait de dispositions arrêtées entre l’opérateur du réseau d’origine et l’opérateur du réseau visité.

In the Communication of 6 April 2016 it was further specified that this would be achieved by developing a harmonised EU common approach, which would include more flexible admission conditions, improved admission procedures and enhanced rights, including intra-EU mobility.

In order to respond more effectively to manpower shortages, the Commission would like to discuss the possibility of improving intra-Community mobility for third-country workers.

Given increased (and encouraged) intra-Community mobility, grounds do exist for wondering whether the provisions currently in force in the Member States which apply in the event of the death of a non-national are in line with Community law – or at least with the thinking behind it – and whether there is a case for seeking to harmonise standards in this field.
Face à une mobilité intracommunautaire renforcée, et encouragée, il y a donc lieu de se demander si les dispositions qui prévalent dans les Etats membres de l'Union en cas de décès d'un non-national sont conformes au droit -ou tout au moins à la "logique"- communautaire, et s'il ne s'agirait pas de procéder à une harmonisation des normes en ce domaine.
