They submit, first of all, that the General Court incorrectly interpreted the second condition for legal professional privilege, which concerns the professional status of the lawyer with whom communications are exchanged, as laid down in the AM SEurope v Commission judgment, and, second, that by that interpretation the General Court breached the principle of equality.
