Senator Joyal: If the Government of Canada is in court against an Aboriginal group on the interpretation of a statute, that Aboriginal group can always claim section 35 if they feel that they have a treaty right or an Aboriginal right. In other words, in that context I do not see how the Interpretation Act would be superior to the obligations that are contained in section 35 that would be alleged by the Aboriginal group to support their contention that the legislation goes against their treaty rights.
