M. whereas the commitment of the Tribunal to the expeditious completion of its mandate is recognised, but whereas the outstanding cases must be tried without being subject to unrealistic time pressures, since such pressures might prejudice the right of the accused to a fair trial; whereas no shortcuts can be taken that might further jeopardise the safety and wellbeing of victims and witnesses testifying before the International Tribunal, and whereas the target date envisaged for the Tribunal's completion strategy cannot mean impunity for the two remaining fugitives or undue time pressures for the ongoing trials,

Urges the Council and the Member States to take all the necessary measures to bring those Iraq régime officials responsible for serious violations of international humanitarian law carried out within Iraq territories and beyond before an ad hoc international tribunal for Iraq; such a tribunal to be established either by United Nations Security Council Resolution under Chapter VII of the UN Charter or pursuant to treaty by the concerned and injured states; and being required, since Article 11 Jurisdiction ratione temporis of the Rome Statute of the International Criminal Court gives jurisdiction only with respect to crimes committed after the entry into force of the Statute, namely, 1 July 2002; while awaiting such establishment, further proposes the setting-up of an Office of Inquiry for human rights violations, in order to prepare both the necessary evidence and an official register of the numerous violations perpetrated by the Iraqi régime; calls on the EU to enable this Office without delay;
5. demande instamment au Conseil et aux États membres de prendre toutes les mesures nécessaires pour que les dirigeants du régime irakien responsables de graves violations du droit international en matière humanitaire sur le territoire de l'Irak ou au-dehors comparaissent devant un Tribunal international ad hoc sur l'Irak; estime qu'un tel tribunal pourrait être fondé soit par une résolution du Conseil de sécurité au titre du chapitre VII de la Charte des Nations unie, soit sur la base de traités avec les États concernés et lésés; estime par ailleurs que cela reste nécessaire puisque l'article 11 du statut de Rome de la Cour pénale internationale dispose, quant à la compétence ratione temporis, que le Cour n'a à connaître que les crimes commis après l'entrée en vigueur du statut, soit après le 1 juillet 2002; en attendant que ce dispositif fonctionne, propose en outre l'instauration d'un bureau d'enquête sur les violations des droits de l'homme, en vue de rassembler les preuves nécessaires et de préparer un registre officiel des nombreuses violations des droits de l'homme perpétrées par le régime irakien; demande à l'UE d'oeuvrer sans délai à la création de ce bureau;
