In order to ensure the effective and efficient registration of international trade marks in a manner that is fully consistent with the rules of the Protocol relating to the Madrid Agreement concerning the international registration of marks, the power to adopt delegated acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of specifying the details on the procedures concerning the filing and examination of an opposition, including the necessary communications to be made to the World Intellectual Property Organisation (WIPO), and the details of the procedure concerning international registrations based on a basic application or basic registration relating to a collective mark, certification mark or guarantee mark.

Regulation (EU) No 654/2014 of the European Parliament and of the Council of 15 May 2014 concerning the exercise of the Union’s rights for the application and enforcement of international trade rules and amending Council Regulation (EC) No 3286/94 laying down Community procedures in the field of the common commercial policy in order to ensure the exercise of the Community’s rights under international trade rules, in particular those established under the auspices of the World Trade Organization (OJ L 189, 27.6.2014, p. 50).

In the case in point, application of these criteria boils down to answering the question of whether, in the light of its context, aim and content, the proposal for a regulation is a measure which chiefly concerns the protection of the environment and which may have a secondary impact on international trade in some categories of waste, whether, on the contrary, it is a measure which chiefly concerns an international commercial policy which takes account, at a secondary level, of certain environmental rules, or whether it is a measure which concerns the two inextricably linked issues of the protection of the environment and international trade.

In the present case, application of those criteria amounts to asking whether the Convention, in the light of its context, its aim and its content, constitutes an agreement principally concerning environmental protection which is liable to have incidental effects on international trade in certain hazardous chemicals and pesticides, whether, conversely, it is principally an agreement concerning international trade policy which incidentally takes account of certain environmental requirements, or whether it is inextricably concerned both with environmental protection and with international trade.

The growth in world trade in chemicals during the 60s and the 70s led to increasing concerns about the risks of using hazardous chemicals and, as a response to these concerns, to the development in 1985 of the International Code of Conduct on the Distribution and Use of Pesticides by the Food and Agriculture Organisation of the United Nations (FAO), and in 1987 of the London Guidelines for the Exchange of Information on Chemicals in International Trade by the United Nations Environment Programme (UNEP).

Council Regulation (EC) No 1992/2003 of 27 October 2003 amending Regulation (EC) No 40/94 on the Community trade mark to give effect to the accession of the European Community to the Protocol relating to the Madrid Agreement concerning the international registration of marks adopted at Madrid on 27 June 1989 [Official Journal L 296 of 14.11.2003]. These two texts are designed to establish a link between the Community trade mark system and the international trade mark registration system of the World Intellectual Property Organisation (WIPO) The aim is to enable enterprises to obtain protection for their trade mark on the basis of the filing of a single application, not only throughout the Community, as a Community trade mark, but also in countries which had signed the Madrid Agreement (such as China).
Ces deux textes visent à établir un lien entre le système de la marque communautaire et le système d'enregistrement international des marques de l'Organisation mondiale de la propriété intellectuelle (OMPI).
