The two applications concern the ‘manufacture of textiles’ sector, which is undergoing serious decline following the expiry of international agreements on textiles and clothing.

That is why the European Union must develop the structural policies and Structural Funds for the textile industry, develop the Seventh Framework Programme for research and development, create a specific Community programme for the development of the textile and clothing sectors, dynamically develop the institutional possibilities offered by the WTO to overturn China's social and environmental dumping and combat the problem of child labour by taking, where necessary, specific defensive trade measures, by safeguarding and defending free and equal access to third country markets and pure competition for European products, by defending consumer rights, by combating piracy and imitations and protecting intellectual property rights and by taking initiatives for a new integrated cooperation agreement with China to replace the 1985 cooperation agreement, which has basically been overtaken by international developments.
C’est pourquoi l’Union européenne doit développer les politiques structurelles et les Fonds structurels en faveur de l’industrie textile, renforcer le septième programme-cadre de recherche et développement, créer un programme communautaire spécifique pour le développement du secteur du textile et de l’habillement, développer de manière dynamique les possibilités institutionnelles offertes par l’OMC pour faire échec au dumping social et environnemental chinois, combattre le problème du travail des enfants en prenant, le cas échéant, des mesures commerciales spécifiques défensives, en sauvegardant et en défendant l’accès libre et équitable aux marchés des pays tiers et la concurrence parfaite pour les produits européens, en défendant les droits des consommateurs, en luttant contre le piratage et les contrefaçons, en protégeant les droits de propriété intellectuelle et en prenant des initiatives en faveur d’un nouvel accord intégré de coopération avec la Chine pour remplacer l’accord de coopération de 1985, rendu obsolète par l’évolution internationale.

With the liberalisation of international trade in textiles and clothing resulting from the end of the Textile and Clothing Agreement on 1 January this year, and China's adhesion to the WTO rules since December 2001, the economic and social situation of the textile and clothing industry is worsening.

Reaffirms that the opening up of international trade in the textile and clothing industry should provide the European industry with a number of opportunities for growth; consequently expects the Commission to maintain in the Doha Development Agreement negotiations the commercial policy proposals it sets out in its Communication, thus safeguarding for the industry access to markets at world level that is comparable to the import conditions that the EU will be applying with effect from 2005;

With this agreement, the Council will be able in the very near future to formally adopt the Regulations and Decisions providing, among other things, for: - the abolition of more than 6 000 national quantitative restrictions and their replacement by a very small number of Community quotas (seven for China, plus a number of textile quotas in respect of certain countries whose products are not covered by bilateral textile agreements); - simplified uniform rules and formalities on importation to be fulfilled by economic operators; - measures to increase the efficiency of the anti-dumping and anti- subsidy investigation procedures that will apply not later than 1 April 1995 when the necessary budget funds have been made available; - a more efficient decision-making procedure for initiating, conducting and concluding an international dispute-settlement procedure; - more efficient administration of textile products not covered by bilateral agreements; - 1 March 1994 as the date on which the transfer of powers on dumping and subsidies to the Court of First Instance will take effect.
Cet accord permettra au Conseil d'adopter formellement, dans les prochains jours, les règlements et décisions prévoyant, entre autres : - l'abolition de plus de 6.000 restrictions quantitatives nationales, et leur remplacement par un nombre très limité de quotas communautaires (7 à l'égard de la Chine, plus quelques quotas textiles à l'égard de certains pays dont les produits ne sont pas couverts par des accords bilatéraux textiles) ; - des règles et des formalités à l'importation simplifiées et uniformes à remplir par les opérateurs économiques ; - des mesures destinées à accroître l'efficacité des procédures d'enquêtes en matière d'anti-dumping et d'antisubventions qui seront applicables, au plus tard, le premier avril 1995, lorsque les ressources budgétaires nécessaires auront été mises à disposition ; - une procédure de prise de décision plus efficace pour l'engagement, la conduite et la clôture d'une procédure internationale de règlement des différends ; - une gestion plus efficace des produits textiles qui ne sont pas couverts par des accords bilatéraux ; - la fixation de la date du premier mars 1994 pour l'entrée en vigueur du transfert de compétences au Tribunal de Première Instance en matière de dumping et de subventions.

1. - External effects of the removal of physical frontiers The establishment of the internal market will result in the removal of the remaining disparities in import and export arrangements. At present there are certain quantitative restrictions in the Member States of the Community affecting mainly East European countries and Japan and also involving the national quotas under the textile agreements or the GSP (generalized system of preferences).
1. - Effets externes de l'élimination des frontières physiques La création du marché intérieur entrainera l'élimination des dernières disparités dans les régimes à l'importation et à l'exportation.En effet, il existe à l'heure actuelle un certain nombre de restrictions quantitatives dans les Etats-membres de la Communauté qui concernent notamment les pays d'Europe de l'Est, le Japon et les quotas nationaux existants dans le cadre des accords textiles ou encore du SPG (Système de Préférences Généralisées).
