Retail tariffs for international mobile communications should not exceed the euro-voice and euro-SMS tariffs for regulated roaming calls and SMS messages, respectively, provided for in Regulation (EU) No 531/2012 unless justified by reference to objective criteria.

Since the objectives of this Regulation, namely to amend Regulation (EC) No 717/2007 and Directive 2002/21/EC in order to maintain and further develop a common set of rules to ensure that users of public mobile communications networks when travelling within the Community do not pay excessive prices for Community-wide roaming services (be it in respect of voice calls, SMS messages or data transmissions), thereby contributing to the smooth functioning of the internal market, while achieving a high level of consumer protection and safeguarding competition between mobile operators, cannot be sufficiently achieved by the Member States in a secure, harmonised and timely manner and can therefore, by reason of the scale and effects of the proposed action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Étant donné que les objectifs du présent règlement, à savoir modifier le règlement (CE) no 717/2007 et la directive 2002/21/CE afin d’instaurer et de développer un ensemble commun de règles pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l’intérieur de la Communauté ne paient pas un prix excessif pour les services d’itinérance communautaire (qu’il s’agisse d’appels vocaux, de SMS ou de transfert de données) et de contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en assurant un degré élevé de protection des consommateurs et en préservant la concurrence entre opérateurs de réseau mobile, ne peuvent pas être réalisés de manière suffisante par les États membres de façon sûre et harmonisée et à temps, et peuvent donc, en raison des dimensions et des effets de l’action proposée, être mieux réalisés au niveau communautaire, la Communauté peut prendre des mesures conformément au principe de subsidiarité consacré à l’article 5 du traité.

2. If the report shows that the structural measures provided for by this Regulation have not been sufficient to promote competition in the internal market for roaming services for the benefit of all European consumers or that the differences between roaming tariffs and national tariffs have not approached zero, the Commission shall make appropriate proposals to the European Parliament and the Council to address this situation and thus achieve an internal market for mobile communication services, ultimately with there being no difference between national and roaming tariffs.

S’il ressort du rapport que les mesures structurelles prévues par le présent règlement ont été insuffisantes pour renforcer la concurrence sur le marché intérieur des services d’itinérance au bénéfice de tous les consommateurs européens ou que les différences entre les tarifs d’itinérance et les tarifs nationaux ne se sont pas rapprochées de zéro, la Commission adresse des propositions appropriées au Parlement européen et au Conseil pour remédier à la situation et réaliser ainsi un marché intérieur des services de communications mobiles, à terme sans distinction entre les tarifs nationaux et les tarifs d’itinérance.

2. The separate sale of regulated roaming services from domestic mobile communications services is a necessary intermediate step to increase competition so as to lower roaming tariffs for customers in order to achieve an internal market for mobile communication services and ultimately for there to be no differentiation between national and roaming tariffs.

The separate sale of regulated roaming services from domestic mobile communications services is a necessary intermediate step to increase competition so as to lower roaming tariffs for customers in order to achieve an internal market for mobile communication services and ultimately for there to be no differentiation between national and roaming tariffs.

In 2006, the International Telecommunication Union (ITU) estimated that the future spectrum bandwidth requirements for the development of International Mobile Telecommunications-2000 (IMT-2000) and IMT-advanced systems (i.e. 3G and 4G mobile communications) would be between 1 280 and 1 720 MHz in 2020 for the commercial mobile industry for each ITU region including Europe.
En 2006, l’Union internationale des télécommunications (UIT) a estimé que les futurs besoins en largeur de bandes de fréquences pour le développement des systèmes de télécommunications mobiles internationales-2000 (IMT-2000) et les systèmes IMT évolués (c’est-à-dire les communications mobiles 3G et 4G) seraient compris entre 1 280 et 1 720 MHz en 2020 pour le secteur des communications mobiles commerciales pour chacune des régions UIT couvrant l’Europe.

This Regulation introduces a common approach to ensuring that users of public mobile communications networks when travelling within the Community do not pay excessive prices for Community-wide roaming services when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, safeguarding competition between mobile operators and preserving both incentives for innovation and consumer choice.

Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l'intérieur de la Communauté ne paient pas un prix excessif pour les services d'itinérance communautaire lorsqu'ils passent et reçoivent des communications vocales, envoient et reçoivent des SMS et utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en préservant la concurrence entre opérateurs de réseau mobile ainsi que les incitations à l'innovation et le choix des consommateurs.

This Regulation introduces a common approach to ensuring that users of public mobile communications networks, with special attention to students, business travellers and reporting journalists and media assistants, when travelling within the Community do not pay excessive prices for Community-wide roaming services when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, safeguarding competition between mobile operators and preserving both incentives for innovation and consumer choice.

Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles, notamment les étudiants, les personnes en voyage d'affaires, les correspondants de presse et les collaborateurs des médias, qui voyagent à l'intérieur de la Communauté ne paient pas un prix excessif pour les services d'itinérance communautaire lorsqu'ils passent et reçoivent des communications vocales, envoient et reçoivent des SMS et utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en préservant la concurrence entre opérateurs de réseau mobile ainsi que les incitations à l'innovation et le choix des consommateurs.
