Expresses deep concern and condolences regarding the events that took place on 16 December 2011 in the Zhanaozen district of Kazakhstan where 16 people died and 110 others were injured; welcomes the establishment of a government commission to investigate into the events; calls on Kazakh authorities to follow through their announcement to conduct objective and transparent investigations in order to bring about reliable information of the events, to bring justice to those found responsible of abuse of office and to allow for international monitoring of the investigations; calls for unfettered access to be granted to international organisations and local civil society organisations to the region;

The Rome Convention is the only instrument of private international law in the Community which is still in international treaty form, with all its drawbacks (possibility for Member States to depart from the common rules by means of national rules or by acceding to multilateral conventions, possibility of entering reservations, limited duration of the Convention); uniform interpretation of the harmonised rules by the Court of Justice: in 1980, the signatory States conferred jurisdiction on the Court of Justice to interpret the Convention, but they took 25 years to ratify the requisite protocols, the Court’s judgments are still not binding on all the Member States, and the national courts are under no obligations in this regard; easier application of the harmonised conflict rules in the new Member States: some of them, it is true, signed a treaty of accession to the Convention in April 2005, but experience with past accessions has shown that several years tend to elapse after the treaty is signed before the Convention comes into force in a new Member State.
La Convention de Rome constitue le seul instrument de droit international privé au niveau communautaire qui revêt encore la forme d’un traité international, ce qui implique des inconvénients (possibilité pour les Etats membres de déroger aux règles communes par des règles nationales ou en adhérant à des conventions multilatérales, celle d’émettre des réserves, durée limitée de la Convention dans le temps). Assurer l’interprétation uniforme des règles harmonisées par la Cour de Justice : certes, les Etats signataires ont prévu, dès 1980, la possibilité pour la Cour de Justice d’interpréter les règles de la Convention ; outre le fait qu’ils ont mis 25 ans avant de ratifier les protocoles nécessaires à cet effet, les décisions de la Cour ne lient toujours pas tous les Etats membres et le recours n’est pas obligatoire pour le juge national. Faciliter l’application des règles de conflit harmonisées dans les nouveaux Etats membres : certes, un traité d’adhésion des nouveaux Etats membres à la Convention a été signé en avril 2005 ; l’expérience des précédentes élargissements démontre toutefois que plusieurs années s’écoulent en général entre la signature d’un tel traité et l’entrée en vigueur de la Convention dans un nouvel Etat membre.

(Return tabled) Question No. 135 Ms. Alexa McDonough: With regard to the death of Canadian citizen Zahra Kazemi in Iran: (a) what specific actions, if any, have the Department of Foreign Affairs and International Trade, the Department of Citizenship and Immigration, the Department of Justice and the Prime Minister’s Office undertaken in Iran, at the United Nations and within other multilateral forums since the government was first notified of Ms. Kazemi’s arrest in Iran; and (b) what specific recommendations, if any, have the Prime Minister and Ministers of Foreign Affairs and International Trade, Citizenship and Immigration, and Justice received from departmental experts, with regard to proposed actions the government may take in Iran, at the United Nations, and within other multilateral forums to ensure (i) that a full and accountable investigation into Ms. Kazemi’s death took place, (ii) that the perpetrators were tried in a fair and transparent trial, and (iii) that her remains were returned to her family in Canada for a full forensic examination and burial?
