In the Commission's view, such a "Scoreboard" should be more than a purely mechanical instrument to facilitate the internal monitoring by the EU institutions of their progress in adopting the legislative and other instruments needed to establish the area of Freedom, Security and Justice.

The Minister of Justice, the SCM and the High Court of Cassation and Justice should finalise an action plan to ensure that the new deadline for the implementation of the remaining provisions of the Code of Civil Procedures can be respected. In order to improve further the transparency and predictability of the legislative process, and strengthen internal safeguards in the interest of irreversibility, the Government and Parliament should ensure full transparency and take proper account of consultations with the relevant authorities and stakeholders in decision-making and legislative activity on the Criminal Code and Code for Criminal Procedures, on corruption laws, on integrity laws (incompatibilities, conflicts of interest, unjustified wealth), on the laws of justice (pertaining to the organisation of the justice system) and on the Civil Code and Code for Civil Procedures, taking inspiration from the transparency in decision-making put in place by the Government in 2016. The Government should put in place an appropriate Action Plan to address the issue of implementation of court decisions and application of jurisprudence of the courts by public administration, including a mechanism to provide accurate statistics to enable future monitoring.
Le ministre de la justice, le CSM et la Haute Cour de cassation et de justice doivent mettre la dernière main à un plan d'action pour que le nouveau délai de mise en œuvre des dispositions restantes du code de procédure civile puisse être respecté; afin d'améliorer davantage la transparence et la prévisibilité du processus législatif, et de renforcer les garde-fous internes dans l'intérêt de l'irréversibilité des résultats, le gouvernement et le Parlement doivent garantir la transparence totale et tenir dûment compte des consultations avec les autorités concernées et les parties prenantes dans le cadre du processus décisionnel et des activités législatives relatives au code pénal et au code de procédure pénale, aux lois sur la corruption, aux lois sur l'intégrité (incompatibilités, conflits d'intérêts, enrichissement injustifié), aux lois de la justice (concernant l'organisation du système judiciaire), ainsi qu'au code civil et au code de procédure civile, en s'inspirant de la transparence du processus décisionnel mis en place par le gouvernement en 2016; le gouvernement doit mettre en place un plan d'action adéquat visant à traiter le problème posé par l'exécution des décisions de justice et l'application de la jurisprudence des cours et tribunaux par l'administration publique, comprenant notamment un mécanisme fournissant des statistiques exactes pour permettre le suivi de ces questions à l'avenir.

Urges the EU to pro-actively contribute and support, at the upcoming HRC session, a resolution relating to the report on follow-up of the committee of independent experts to the international Fact-Finding mission on the Gaza conflict in order to ensure accountability for the violations of international law and support a referral to the GA and to International Justice mechanisms in case of Israel and Palestinian parties have failed to comply with their obligation to carry out investigations according to international standards; further calls on the High Representative to actively monitor compliance with the findings of the ‘Follow-up to the report of the international fact-finding mission on the incident of the humanitarian flotilla’, ensuring principles of accountability and liability are upheld; welcomes the statements by the UN High Commissioner for Human Right on her first visit to the occupied Palestinian territory and Israel and, in particular, the strong message that she conveyed that all settlement-related activities are illegal and that ‘international human rights law and international humanitarian law are not negotiable’;

Actions under this objective will include activities to support local civil society's contribution to EU human rights dialogues (in line with the relevant EU guidelines) and the development and implementation of international and regional human rights and international criminal justice instruments and mechanisms, including the International Criminal Court.
Les actions menées au titre du présent objectif incluront des activités visant à aider la société civile locale à apporter sa contribution aux dialogues mis en place par l'Union dans le domaine des droits de l'homme (conformément aux orientations et lignes directrices de l'Union en la matière) et faciliteront l'élaboration et la mise en œuvre d'instruments et de mécanismes internationaux et régionaux dans les domaines des droits de l'homme et de la justice pénale internationale, notamment la Cour pénale internationale.

(1) The Justice and Home Affairs Council meeting on 20 September 2001 decided, as recorded in point 15 of its Conclusions, to instruct the Article 36 Committee to work out an easier and swifter form of the evaluation mechanism defined in Joint Action 97/827/JHA of 5 December 1997 establishing a mechanism for evaluating the application and implementation at national level of international undertakings in the fight against organised crime(3), in order to define a procedure for the peer assessment of national anti-terrorist arrangements.
