WHEREAS the Internet is a national and international asset of great value in communication, education and research; AND WHEREAS the usefulness and efficiency of the Internet is threatened by large volumes of unsolicited messages that by their volume constitute a nuisance and waste time; AND WHEREAS many of these messages contain or offer pornographic material, advocate illegal activities or solicit or offer business that is of no interest to recipients; AND WHEREAS Internet service providers have an ability to cooperate to control unwanted messages; AND WHEREAS, because of the international nature of the Internet, both international cooperation and the cooperation and regulation of Internet service providers in Canada are necessary to control the flow of such messages; NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Julian Fantino (Minister of International Cooperation, CPC): Mr. Speaker, with regard to (a), mitigation actions and measures taken to protect the interests of the Crown when an organization in receipt of the Canadian International Development Agency, CIDA, funding is under legal protection from creditors include conducting an internal, or contracting an external, review and assessment of potential program, legal, fiduciary and political/reputational risks that may arise; alerting the recipient country ministry or partner institution of potential project impacts; reviewing the contractual and performance terms and conditions of the agreement or agreements signed; based on the assessment and severity of the financial situation, developing a risk mitigation and monitoring plan, usually in consultation with the organization or service provider and their lenders, as well as the recipient country ministry or partner institution, if required; obtaining financial statements, forecasts and operational plans from the organization or service provider to closely monitor and track progress in addressing the situation and returning to normal business operations; ensuring that all advance payments are secured by means of irrevocable bank guarantees issued by acceptable financial institutions and that any financial performance guarantees are enforceable, in case of need; and not entering into any new agreements until such time as the organization or service provider has demonstrated their financial capacity, returned to normal business operations and is no longer under the protection of the courts.
L'hon. Julian Fantino (ministre de la Coopération internationale, PCC): Monsieur le Président, en réponse à la partie a) de la question, voici les mesures prises pour atténuer le risque et protéger les intérêts de la Couronne lorsqu’une organisation qui reçoit des fonds de l’Agence canadienne de développement international, l’ACDI, est sous protection juridique contre les créanciers: on effectue à l’interne, ou on confie la tâche à un tiers sous contrat, un examen et une évaluation pour déterminer les risques fiduciaires, politiques, d’atteinte à la réputation ou liés au programme que la situation comporte; on prévient le ministère ou l’institution partenaire du pays bénéficiaire des répercussions possibles du projet; on examine les modalités contractuelles et les conditions en matière de rendement du ou des accords signés; selon les conclusions de l’évaluation et la gravité de la situation financière, on établit un plan de suivi et d’atténuation des risques, habituellement après consultation avec l’organisation ou le fournisseur de services et leurs prêteurs, ainsi qu’avec le ministère ou l’institution partenaire du pays bénéficiaire, si nécessaire; on obtient les états financiers, les prévisions et les plans opérationnels de l’organisation ou du fournisseur de services en vue du redressement de la situation et de la reprise des activités normales — l’information en question est utilisée pour suivre de près les progrès réalisés; on s’assure que tous les paiements anticipés sont couverts par des garanties bancaires irrévocables émanant d’institutions financières acceptables et que toute garantie financière liée au rendement sera exigible en cas de besoin; et on s’abstient de conclure de nouveaux accords jusqu’à ce que l’organisation ou le fournisseur de services ait fait la preuve de sa capacité financière, ait repris ses activités normalement et ne soit plus sous la protection des tribunaux.

The Convention established a regional fisheries management organisation, the North-East Atlantic Fisheries Commission (NEAFC), with the aim of promoting the conservation and optimum utilisation of fisheries resources of the North-East Atlantic within a framework appropriate to the regime of extended coastal state jurisdiction over fisheries, and accordingly of encouraging international cooperation and consultations with respect to resources.

It proceeds by means of international cooperation and consultation, which enables it to issue binding recommendations in respect of fishing activities engaged in outside the waters controlled by the contracting parties. Its recommendations must be complied with by the parties unless the latter raise an objection within 50 days of the date upon which the recommendation was notified.

This amendment to clause 15 proposes replacing line 16 to 19 on page 11 with the following: “15 (1) The Minister or the Minister for International Cooperation may make an order requiring a licensee to provide to Her Majesty in right of Canada any service through the licensed system that the Minister or the Minister for International Cooperation believes on reasonable” grounds is desirable for the conduct of international relations or the performance of Canada’s international obligations. It seems to me, Mr. Speaker, that it's an oversight not to stipulate the Minister for International Cooperation in this particular clause.

IV. THE COUNCIL CALLS ON THE COMMISSION TO: 20. follow-up, as appropriate, the consultation already under way on the Green Papers "Living and working in the information society"[18] , New audiovisual services, "Copyright and related rights in the information society"[19] , "The legal protection of encrypted services"[20] and "Commercial communications in the internal market" [21] ; 21. analyze potential barriers to the development of new information society services, in particular electronic commerce; 22. analyze the impact of information and communications technologies on the competitiveness of industry sectors and submit proposals for a European initiative to stimulate the use of information and communication technologies, in particular for SMEs; 23. intensify international cooperation, in particular to assist the accession countries in their preparation for the information society and to improve communication with other regions, in order to promote the global information society; 24. report to Council on the competitive position of the ICT industry and the state of implementation of the 1991 Resolution on the ICT Industry.
LE CONSEIL INVITE LA COMMISSION : 20. à assurer le suivi, comme il convient, de la consultation déjà en cours sur les Livres verts intitulés "Vivre et travailler dans la société de l'information" [19] , "Nouveaux services audiovisuels", "Le droit d'auteur et les droits voisins dans la société de l'information" [20] , "La protection juridique des services cryptés dans le marché intérieur" [21] et "Les communications commerciales dans le marché intérieur" [22] ; 21. à analyser les entraves qui pourraient faire obstacle à la mise au point de nouveaux services de la société de l'information, notamment du commerce électronique ; 22. à analyser l'incidence des technologies de l'information et des communications sur la compétitivité de certains secteurs de l'industrie et à présenter des propositions concernant une initiative européenne visant à encourager l'utilisation des technologies de l'information et des communications, notamment à l'intention des PME ; 23. à intensifier la coopération internationale, notamment à aider les pays candidats à l'adhésion dans leur préparation à la société de l'information et à améliorer les communications avec d'autres régions, afin de promouvoir la société globale de l'information ; 24. à faire rapport au Conseil sur la position concurrentielle de l'industrie des technologies de l'information et des communications et sur l'état d'avancement de la mise en oeuvre de la résolution de 1991 sur l'industrie des technologies de l'information et des communications.
