This Article lays down a rule for the application of the international conventions referred to in Articles 38 and 39 both in relation to matters to which this Convention does not apply (paragraph 1) and in respect of judgments given before the entry into force of this Convention (paragraph 2) but does not provide for any transitional rule on the latter issue, without prejudice to what is laid down in Article 37, allowing recognition under this Convention for judgments given by virtue of a ground of jurisdiction recognised in the Convention.
