The Advocate General considers that whilst in principle there can be no objection to using Article 114 TFUE as a legal basis for EU agencies which adopt legally binding decisions, the determining factor is whether the decisions of the agency in question either contribute to or amount to internal market harmonisation.

In his Opinion delivered today, Advocate General Yves Bot notes that the Court of Justice has already stated that, even though the institutions of the EU have only a limited freedom of action in giving effect to international law and without calling into question the primacy of a Security Council resolution at the international level, requiring Community institutions to pay due regard to the institutions of the UN cannot result in their abstaining from reviewing the lawfulness of Community measures in the light of fundamental rights. It would, in his view, be wrong for the Court to reverse its decision not to grant immunity from review to an act such as the contested regulation.

The Commission advocates a policy based on: - the common application of internationally-agreed rules. - a joint effort by Community and Member States in the IMO (International Maritime Organisation) to agree on a worldwide basis on certain conditions for flag administrations and their ship registers. - a Directive laying down certain principles for Member States' shipping registers - - strengthening port State control through operational links with other third countries - promoting self-regulatory codes of behaviour - encouraging operators to achieve high quality standards (eg. lower port charges for high quality ships) - the consideration of legal action or fines for cargo owners who use sub- standard shipping - With the implementation of OECD Agreement on Commercial Shipbuilding and Repair Industry and the phasing out of direct state aid to shipbuilding, the Commission is advocating the development of a new financing scheme for maritime projects in accordance with the new OECD regime.
