TRADUCTIONS EN CONTEXTE

Since the objectives of this Regulation, namely the development and implementation of a system of integrated management of the external borders to ensure the proper functioning of the Schengen area, cannot be sufficiently achieved by the Member States acting in an uncoordinated manner but can rather, by reason of the absence of controls at internal borders, the significant migratory challenges at the external borders, the need to monitor efficiently the crossing of those borders, and to contribute to a high level of internal security within the Union, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the TEU.
Étant donné que les objectifs du présent règlement, à savoir le développement et la mise en œuvre d'un système de gestion intégrée des frontières extérieures en vue d'assurer le bon fonctionnement de l'espace Schengen, ne peuvent pas être atteints de manière suffisante par les États membres agissant de manière non coordonnée, mais peuvent, en raison de l'absence de contrôles aux frontières intérieures, des importants défis migratoires aux frontières extérieures, de la nécessité de contrôler efficacement le franchissement de ces frontières et de contribuer à un niveau élevé de sécurité intérieure au sein de l'Union, l'être mieux au niveau de l'Union, celle-ci peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité sur l'Union européenne.

(39)Since the objectives of this Regulation, namely the development and implementation of a system of integrated management of the external borders, thus also ensuring the proper functioning of the Schengen area, cannot be sufficiently achieved by the Member States acting in an uncoordinated manner but can rather, because of the absence of controls at internal borders and in view of the significant migratory pressures at the external borders and the need to safeguard a high level of internal security within the Union, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article of the Treaty on European Union.

In these circumstances, as an individual and as a politician, I cannot rejoice at no longer having to pass through border controls at internal borders, since criminals and illegal immigrants do not have to do so either, and that is pernicious to our society.

The report will cover all provisions related to internal borders, i.e. the abolition of border control at internal borders, checks within the territory, removal of obstacles to traffic at road crossing points and the temporary reintroduction of border control at internal borders, including the experiences and difficulties arising from the application of these provisions since the entry into force of the Regulation.
Le rapport couvrira toutes les dispositions concernant les frontières intérieures, à savoir la suppression du contrôle aux frontières intérieures, les contrôles sur le territoire, la levée des obstacles à la circulation aux postes frontières routiers et la réintroduction temporaire du contrôle aux frontières intérieures, en tenant compte des expériences et difficultés nées de l’application de ces dispositions depuis l’entrée en vigueur du règlement.

The regulation, however, goes further than a mere makeover, because it establishes a veritable Community Code governing the movement of persons across borders, not only relating to the external borders of the Union but also, as I said, with a component on the internal borders, since these two aspects are undeniably complementary.

It applies to Iceland and Norway since it constitutes a development of the provisions of the Schengenacquis (i.e. the existing EU laws on the Schengen area - an area in Europe without internal borders in which citizens, many non-EU nationals and tourists can freely move without border checks), as well as to Switzerland and Liechtenstein.

When a person travels between Sweden and another Schengen State on a regular ferry connecting exclusively from or to ports within the territories of the Schengen States and not calling on any ports outside those territories, no control will take place since this connection is considered as the crossing of an internal border.

Others argued in favour of free movement for everyone, which would mean an end to internal border checks altogether. Since Member States could not reach agreement, France, Germany, Belgium, Luxembourg and the Netherlands decided in 1985 to create a territory without internal borders. This became known as the "Schengen area", after the town in Luxembourg where the first agreements were signed.
D’autres États membres, au contraire, souhaitaient établir une libre circulation pour tous et, par conséquent, supprimer ces contrôles frontaliers.
