Annual repayments, including capital repayments, guarantees released, and repayments of the principal of loans, paid back to the Commission or fiduciary accounts opened for financial instruments and attributable to the support from the budget under a financial instrument, shall constitute internal assigned revenue in accordance with Article 21 and shall be used for the same financial instrument, without prejudice to paragraph 9 of this Article, for a period not exceeding the period for the commitment of appropriations plus two years, unless specified otherwise in a basic act.

2. For Community actions financed under the Instrument, Regulations (EC, Euratom) No 2988/95 and (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated under the Instrument, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it by an unjustified item of expenditure.
2. En ce qui concerne les actions communautaires financées au titre de l'instrument, les règlements (CE, Euratom) no 2988/95 et (Euratom, CE) no 2185/96 s'appliquent à toute violation d'une disposition du droit communautaire, y compris aux violations d'une obligation contractuelle en vertu de l'instrument, résultant d'un acte ou d'une omission d'un opérateur économique qui a, ou aurait, pour effet de porter préjudice au budget général de l'Union européenne, ou à des budgets gérés par celle-ci, par une dépense indue.
