Where a resolution authority purports to transfer or transfers all of the property, rights and liabilities of an institution to another entity, but the transfer is or may not be effective in relation to certain property because it is outside the Union, or to certain rights or liabilities because they are under the law of a territory outside the Union, the resolution authority shall not proceed to the transfer or, if it has already ordered the transfer, that transfer shall be void, and all property, rights and liabilities covered by the relevant arrangement specified in Article 69(2) are not transferred from, or revert to, the institution under resolution.

2. Member States shall recognise as eligible counterparties for the purposes of this Article investment firms, credit institutions, insurance companies, UCITS and their management companies, pension funds and their management companies, other financial institutions authorised or regulated under Union law or under the national law of a Member State, national governments and their corresponding offices including public bodies that deal with public debt at national level, central banks and supranational organisations.
2. 4. Without prejudice to the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union, where a competent authority does not comply with the decision of the Authority, and thereby fails to ensure that a financial institution complies with requirements directly applicable to it by virtue of the legislative acts referred to in Article 1(2), the Authority shall adopt an individual decision addressed to a financial institution requiring the necessary action to comply with its obligations under Union law, including the cessation of any practice.
4. Sans préjudice des compétences dévolues à la Commission au titre de l'article 259 du traité sur le fonctionnement de l'Union européenne, si une autorité compétente ne se conforme pas à la décision de l'Autorité en ne veillant pas à ce qu'un établissement financier remplisse les exigences qui lui sont directement applicables en vertu des actes législatifs visés à l'article 1er, paragraphe 2, l'Autorité adopte à l'égard dudit établissement financier une décision individuelle lui imposant de prendre les mesures nécessaires pour respecter les obligations qui lui incombent en vertu du droit de l'Union, notamment la cessation d'une pratique.

6. Without prejudice to the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union, where a competent authority does not comply with the decision referred to in paragraph 4 of this Article within the period of time specified therein, and where it is necessary to remedy in a timely manner the non-compliance by the competent authority in order to maintain or restore neutral conditions of competition in the internal market or ensure the orderly functioning and integrity of the financial system in the internal market, the Authority may, where the relevant requirements of the legislation referred to in Article 1(2) are directly applicable to financial institutions, adopt an individual decision addressed to a financial institution requiring the necessary action to comply with its obligations under Union law including the cessation of any practice.
6. Sans préjudice des compétences dévolues à la Commission au titre de l'article 258 du traité sur le fonctionnement de l'Union européenne, si une autorité compétente ne se conforme pas à la décision visée au paragraphe 4 du présent article dans le délai imparti, et si ce manquement réclame une intervention rapide afin de maintenir ou de rétablir des conditions de concurrence neutres sur le marché intérieur ou d'assurer le bon fonctionnement et l'intégrité du système financier au sein du marché intérieur, l'Autorité peut, lorsque les exigences concernées de la législation visée à l'article 1, paragraphe 2, sont directement applicables aux établissements financiers, adopter à l'égard d'un établissement financier une décision individuelle lui imposant de prendre les mesures nécessaires pour respecter les obligations qui lui incombent en vertu du droit de l'Union, notamment la cessation d'une pratique.
