At its meeting in Berlin on 24 March 1999, the European Council reached a political agreement on the Commission's proposals, so allowing the institutions to continue examining the Agenda 2000 legislative package and to adopt the final measures before or immediately after the election of the new Parliament in June 1999.

2. Where the institution of the last Member State under the legislation of which the person concerned pursued an activity likely to cause the occupational disease in question establishes that the person concerned or his survivors do not meet the requirements of that legislation, inter alia, because the person concerned had never pursued in that Member State an activity which caused the occupational disease or because that Member State does not recognise the occupational nature of the disease, that institution shall forward without delay the declaration or notification and all accompanying certificates, including the findings and reports of medical examinations performed by the first institution to the institution of the previous Member State under the legislation of which the person concerned pursued an activity likely to cause the occupational disease in question.

(2) Before commencing a special examination, an examiner shall survey the systems and practices of the institution to be examined and submit a plan for the examination, including a statement of the criteria to be applied in the examination, to the audit committee of the institution.

That must always be true except in certain particular cases where an examination of the actual situation of an official declared to be in a state of invalidity shows that he is no longer capable of one day resuming his duties within an institution, having regard to, for instance, findings of the Invalidity Committee responsible for examining his degree of invalidity, from which it is clear that the illness which led to the invalidity is permanent and that no medical review will therefore be necessary, or in the light of statements by the official concerned, from which it is clear that he will not, in any event, be returning to work within an institution.
