33. Where the head of a government institution refuses to disclose a record requested under this Act or a part thereof and receives a notice under section 32 of a complaint in respect of the refusal, the head of the institution shall forthwith advise the Information Commissioner of any third party that the head of the institution has notified under subsection 27(1) in respect of the request or would have notified under that subsection if the head of the institution had intended to disclose the record or part thereof.
33. 43 (1) The head of a government institution who has refused to give access to a record requested under this Act or a part thereof shall forthwith on being given notice of any application made under section 41 or 42 give written notice of the application to any third party that the head of the institution has notified under subsection 27(1) in respect of the request or would have notified under that subsection if the head of the institution had intended to disclose the record or part thereof.

In the Judgment of the Court of Justice of the European Communities of 29 April 1999 in Case C-342/96 Spain v Commission (hereinafter Tubacex) (3), the Court considered that the debt rescheduling agreements concluded by the TGSS and FOGASA did not constitute State Aid as those public institutions had acted as a private creditor would have done to try to recover amounts owed to it, provided that the interest rate was at least equal to the rate that a private creditor would have applied (4) and that the rescheduling agreement did not result in new debts being accumulated.

The government had argued that the commitment under section 41 of the OLA was a political commitment only, that it did not place any binding obligation on federal institutions, nor create any right that could be enforced by the courts.[1] For the communities and various official languages commissioners however, Part VII conferred a positive obligation on federal institutions to act and take steps to promote the communities’ development, as well as the recognition of French and English. For those communities and commissioners, any failure to meet this obligation could have legal ramifications.[2]
