The presumption of innocence is a fundamental right, laid down in the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and the Charter of Fundamental Rights of the European Union (CFREU).
La présomption d'innocence est un droit fondamental, consacré par la convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales (ci-après, la «CEDH») ainsi que par la charte des droits fondamentaux de l'Union européenne (ci-après, la «Charte»).

The presumption of innocence and the right to a fair trial are enshrined in Articles 47 and 48 of the Charter of Fundamental Rights of the European Union (the Charter), Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (the ECHR), Article 14 of the International Covenant on Civil and Political Rights (the ICCPR) and Article 11 of the Universal Declaration of Human Rights.

The EU Strategic Framework and Action Plan on Human Rights and Democracy, adopted by the Council on 25 June 2012, calls for the development of operational guidance to ensure that human rights are taken into consideration in the design and implementation of counter-terrorism assistance measures, and underlines that the eradication of torture and other cruel, inhuman or degrading treatment and respect for due process (including the presumption of innocence, the right to a fair trial and rights of defence) are a Union priority in the implementation of human rights.
Le cadre stratégique et le plan d'action de l'UE en faveur des droits de l'homme et de la démocratie, adoptés par le Conseil le 25 juin 2012, prévoient l'élaboration d'orientations opérationnelles afin de garantir la prise en compte des droits de l'homme dans la conception et la mise en œuvre des mesures d'aide à la lutte contre le terrorisme et soulignent que l'éradication de la torture et d'autres peines ou traitements cruels, inhumains ou dégradants ainsi que le respect des procédures régulières (y compris la présomption d'innocence, le droit à un procès équitable et les droits de la défense) constituent une priorité pour l'Union dans la mise en œuvre des droits de l'homme.

2. In accordance with the EU Strategic Framework and Action Plan on Human Rights and Democracy, the Commission shall develop operational guidance to ensure that human rights are taken into consideration in the design and implementation of the measures referred to in paragraph 1, in particular as regards the prevention of torture and other cruel, inhuman or degrading treatment and respect for due process, including the presumption of innocence, the right to a fair trial and rights of defence.
2. En conformité avec le cadre stratégique et le plan d'action de l'Union en faveur des droits de l'homme et de la démocratie, la Commission élabore des orientations opérationnelles afin de garantir la prise en compte des droits de l'homme dans la planification et la mise en œuvre des mesures visées au paragraphe 1, notamment en ce qui concerne la prévention de la torture et autres traitements cruels, inhumains ou dégradants et le respect des procédures régulières, y compris la présomption d'innocence, le droit à un procès équitable et les droits de la défense.

This Directive respects human rights and fundamental freedoms and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and the European Convention for the Protection of Human Rights and Fundamental Freedoms, including the protection of personal data, the right to privacy, freedom of expression and information, the right to a fair trial, the presumption of innocence and the rights of the defence, as well as the principles of legality and proportionality of criminal offences and penalties.
La présente directive respecte les droits de l’homme et les libertés fondamentales et est conforme aux principes consacrés en particulier par la Charte des droits fondamentaux de l’Union européenne et la convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales, notamment la protection des données à caractère personnel, le droit au respect de la vie privée, la liberté d’expression et d’information, le droit à un procès équitable, la présomption d’innocence et les droits de la défense, ainsi que les principes de légalité et de proportionnalité des infractions et sanctions pénales.

Third, that the Council decision and the Council Regulations amount to a breach of the applicant’s fundamental rights as protected by the EU Charter of Fundamental Rights and/or the European Convention of human Rights including the applicant’s right to human dignity, right to a good administration, right to an effective remedy and a fair trial, right to be presumed innocent and rights of defence, right to respect for his private and family life, home and communications, freedom to conduct a business, and his right to property.

(18) This Directive should apply to suspects or accused persons regardless of their legal status, citizenship or nationality.This Directive upholds the fundamental rights and principles recognised by the Charter of Fundamental Rights of the European Union and the European Convention on Human Rights, including the prohibition of torture and inhuman and degrading treatment, the right to liberty and security, respect for private and family life, the right to the integrity of the person, the rights of the child, integration of persons with disabilities, the right to an effective remedy and the right to a fair trial, the presumption of innocence and the rights of the defence.
(18) La présente directive devrait s’appliquer aux suspects et aux personnes poursuivies, et ce quels que soient leur statut juridique, leur citoyenneté et leur nationalité. La présente directive respecte les droits fondamentaux et observe les principes reconnus en particulier par la Charte des droits fondamentaux de l'Union européenne et la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales, y compris l'interdiction de la torture et des peines ou traitements inhumains ou dégradants, le droit à la liberté et à la sûreté, le respect de la vie privée et familiale, le droit à l'intégrité de la personne, les droits de l'enfant, l'intégration des personnes handicapées, le droit à un recours effectif en justice et à un procès équitable, la présomption d'innocence et les droits de la défense.
