The provisions of this Regulation shall, in the field of transport by rail, road and inland waterway, apply both to all agreements, decisions and concerted practices which have as their object or effect the fixing of transport rates and conditions, the limitation or control of the supply of transport, the sharing of transport markets, the application of technical improvements or technical cooperation, or the joint financing or acquisition of transport equipment or supplies where such operations are directly related to the provision of transport services and are necessary for the joint operation of services by a grouping within the meaning of Article 3 of road or inland waterway transport undertakings, and to the abuse of a dominant position on the transport market.

1. This Directive applies to the implementation and operation of RIS on all inland waterways of the Member States of class IV and above which are linked by a waterway of class IV or above to a waterway of class IV or above of another Member State, including the ports on such waterways as referred to in Decision No 1346/2001/EC of the European Parliament and of the Council of 22 May 2001 amending Decision No 1692/96/EC as regards seaports, inland ports and intermodal terminals as well as project No 8 in Annex III .

La présente directive est applicable à la mise en œuvre et au fonctionnement des SIF sur toutes les voies navigables des États membres de classe IV et supérieure qui sont reliées par une voie navigable de classe IV ou supérieure à une voie navigable de classe IV ou supérieure d'un autre État membre, ainsi que dans les ports situés sur ces voies navigables tels que visés par la décision no 1346/2001/CE du Parlement européen et du Conseil du 22 mai 2001 modifiant la décision no 1692/96/CE en ce qui concerne les ports maritimes, les ports de navigation intérieure et les terminaux intermodaux ainsi que le projet no 8 à l'annexe III .

3. Following a request by a Member State, the Commission may extend in accordance with the procedure laid down in Article 11(2), the period provided for in paragraph 2 for the implementation of one or more requirements of Article 4 in respect of inland waterways falling within the scope of Article 2 but with low traffic density, or in respect of inland waterways for which the cost of such implementation would be disproportionate to its benefits.
3. À la demande d'un État membre, la Commission peut, conformément à la procédure visée à l'article 11, paragraphe 2, prolonger le délai prévu au paragraphe 2 du présent article pour satisfaire à l'une ou plusieurs des exigences de l'article 4, en ce qui concerne les voies navigables relevant des dispositions de l'article 2 mais à faible intensité de trafic ou en ce qui concerne les voies navigables pour lesquelles les dépenses nécessaires pour satisfaire à ces exigences seraient disproportionnées par rapport aux avantages.

ORGANIZATION OF THE INLAND WATERWAY TRANSPORT MARKET AND SUPPORTING MEASURES - THE COUNCIL'S CONCLUSIONS "Following the policy debate it held on the Commission proposals on the organization of the inland waterway transport market and supporting measures, the Council: 1. took note of the action programme submitted by the Commission in response to the request made in the Council Resolution of 24 October 1994; 2. agreed on the principle of liberalization of the inland waterway transport market which gradually limits the scope of the rotation system in order to arrive at a system where there is freedom as regards chartering and pricing in inland waterway transport by 1 January 2000; 3. underlined the need for further substantial structural improvements in order to reduce the capacity of the active fleet by around 15%, while noting that the possibilities for funding such a measure are still to be defined; 4. instructed the Permanent Representatives Committee, in collaboration with the Commission and the Member States, to continue discussions on this matter".
ORGANISATION DU MARCHE DE LA NAVIGATION INTERIEURE ET DES MESURES D'ACCOMPAGNEMENT - CONCLUSIONS DU CONSEIL "Suite au débat d'orientation qu'il a tenu sur les propositions de la Commission relatives à l'organisation du marché de la navigation intérieure et aux mesures d'accompagnement, le Conseil a : 1. pris acte du programme d'action présenté par la Commission suite à la demande exprimée dans la résolution du Conseil du 24 octobre 1994 ; 2. marqué son accord sur le principe d'une libéralisation du marché fluvial qui limite progressivement le champ d'application du tour de rôle afin d'aboutir à un régime de liberté d'affrètement et de formation des prix du transport par voie navigable au 1er janvier 2000 ; 3. souligné la nécessité d'un nouvel assainissement structurel d'envergure, en vue de réduire la capacité de la flotte active d'environ 15 % tout en constatant que les possibilités de financement de cette action restent à déterminer ; 4. chargé le Comité des représentants permanents, en collaboration avec la Commission et les Etats membres, de continuer les travaux sur ce dossier".

to further develop national policies to stimulate inland waterway transport, taking into account the European Action Programme, and to encourage regional, local and port authorities and industries to do likewise; to strive for providing sufficient financial resources and incentives for the targeted implementation of the proposed measures, in particular through cost-effective national schemes for the support of inland navigation; to establish promotion centres for inland waterway transport and to provide appropriate political, practical and financial support from administrations and the inland navigation sector to safeguard support services on a continuous basis; to appoint national focal points according to the objectives of the European Action Programme in order to provide advice concerning legal requirements and administrative procedures; to contribute to the creation of a common framework for education and training standards, both regarding personnel on board - in particular focusing on managerial, technological, linguistic and nautical knowledge - as well as regarding the logistic chain through the integration of knowledge on inland navigation in logistics education programmes; to screen national and regional legislation for administrative and procedural requirements, which may constitute an unnecessary and inappropriate burden for the development of inland waterway transport; to develop spatial planning and economic policies at federal, regional and local levels to encourage waterside sites for logistics purposes; to actively pursue inland waterway transport and infrastructure projects that promote viable inland waterway transport services, including those projects interlinking Member States and supported by Community programmes such as TEN-T; to consider how national programmes and projects can contribute to the European Development Plan for improvement and maintenance of inland waterway infrastructure the Commission intends to create; to contribute ...

The package comprises: - a Directive on the organization of the inland waterway transport market which provides for the abolition by 1 January 2000 of the systems of minimum compulsory tariffs and the "rotation" system; - a Regulation amending Regulation No 1107/70 on the granting of aids for certain inland waterway transport infrastructure; the proposal would allow a system of national aid to support investment in certain types of inland waterway infrastructure to be implemented until 31 December 1999; - a proposal for a Regulation amending Regulation No 1101/89 on structural improvements in inland waterway transport, allowing for the possibility of Community part-financing for national scrapping funds.
Celui-ci comprend : - la directive sur l'organisation du marché de la navigation intérieure prévoyant la disparition, au plus tard le 1er janvier 2000, des régimes des tarifs minimum obligatoires et du système dit de "tour de rôle" ; - le règlement modifiant le règlement nu 1107/70 relatif aux aides accordées à certaines infrastructures de la navigation intérieure visant à permettre la mise en oeuvre jusqu'au 31 décembre 1999 d'un régime d'aides nationales pour soutenir les investissements dans certaines infrastructures fluviales ; - la proposition de règlement modifiant le règlement nu 1101/89 relatif à l'assainissement structurel de la navigation intérieure qui prévoit la possibilité d'un cofinancement communautaire des fonds de déchirage nationaux.
