(67) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty on European Union, the objectives of this Directive, namely to foster the development of the Union railways, to set out broad principles for granting licences to railway undertakings and to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof, cannot be sufficiently achieved by the Member States on account of the manifestly international dimensions of issuing such licences and operating significant elements of the railway networks, and in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure and the objectives can therefore, by reason of their trans-national implications, be better achieved by the Union.
(67) Étant donné que les objectifs de la présente directive, à savoir favoriser le développement des chemins de fer de l'Union, établir de grands principes en matière d'octroi de licences aux entreprises ferroviaires, et coordonner les systèmes des États membres régissant la répartition des capacités d'infrastructure ferroviaire et la perception des redevances d'utilisation de ladite infrastructure, ne peuvent pas être réalisés de manière suffisante par les États membres compte tenu de la dimension manifestement internationale de l'octroi de ces licences et du fonctionnement d'éléments importants des réseaux ferroviaires et compte tenu de la nécessité d'assurer des conditions d'accès équitables et non discriminatoires à l'infrastructure et peuvent donc, en raison de leurs aspects transnationaux, être mieux réalisés au niveau de l'Union conformément aux principes de subsidiarité et de proportionnalité tels qu'énoncés à l'article 5 du traité de l'Union européenne, la présente directive n'excède pas ce qui est nécessaire pour atteindre ces objectifs.

3. For any request of infrastructure capacity which cannot be met pursuant to paragraph 2a, the one-stop shop shall forward the application for infrastructure capacity without any delay to the competent infrastructure managers and, where relevant, the allocation bodies as referred to in Article 14(2) of Directive 2001/14/EC, who shall take a decision on that application in accordance with Article 13 and Chapter III of that Directive and communicate this decision to the one-stop shop for further processing.
3. Pour toute demande concernant les capacités d'infrastructure qui ne peut être traitée conformément au paragraphe 2 bis, le guichet unique transmet sans tarder la demande de capacités d'infrastructure aux gestionnaires de l'infrastructure compétents et, le cas échéant, aux organismes de répartition visés à l'article 14, paragraphe 2, de la directive 2001/14/CE, qui prennent une décision sur cette demande conformément à l'article 13 et au chapitre III de ladite directive et communiquent cette décision au guichet unique en vue de la suite à donner.

(49) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty, the objectives of this Directive, namely to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof as well as safety certification, cannot be sufficiently achieved by the Member States in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure as well as to take account of the manifestly international dimensions involved in the operation of significant elements of the railway networks, and can therefore, by reason of the need for coordinated trans-national action, be better achieved by the Community.
(49) Conformément au principe de subsidiarité et au principe de proportionnalité tels qu'énoncés à l'article 5 du traité, les objectifs de la présente directive, à savoir la coordination des systèmes des États membres régissant la répartition des capacités d'infrastructure ferroviaire et la perception de redevances d'utilisation de ladite infrastructure ainsi que la délivrance des certificats de sécurité, ne peuvent pas être réalisés de manière suffisante par les États membres, compte tenu de la nécessité d'assurer des conditions équitables et non discriminatoires pour l'accès à l'infrastructure et de tenir compte de la dimension manifestement internationale du fonctionnement d'éléments importants des réseaux ferroviaires, et peuvent donc être mieux réalisés au niveau communautaire en raison de la nécessité d'une action transnationale coordonnée.
