Without wishing to reiterate the various criticisms of the substance of the planned rules set out at points 3.2.1 and 3.2.2. here, since that will be examined more closely at point 4.2., the range of instruments applicable between the EU Member States to meet the concern to recognise and enforce sanctions in another Member State is also rather incomplete and, where it actually exists (as in the case of the Council of Europe Convention of 21 March 1983 on the transfer of sentenced persons), capable of improvement.
