Any extension pursuant to paragraph 2 shall be preceded by an investigation upon a request by a Member State, by any legal person or any association not having legal personality, acting on behalf of the Union industry, or on the Commission’s own initiative if there is sufficient prima facie evidence that the safeguard measure continues to be necessary.

An investigation is initiated when a written complaint is lodged by the EU industry or on the Commission's own initiative.

The proceeding led to the imposition of a duty on certain manufacturers in October of that year and the acceptance of undertakings made by other manufacturers, among them Ricoh. After that investigation the Commission discovered that Ricoh's wholly- owned French subsidiary, Ricoh Industrie France S.A., had started manufacture or assembly of the product in question in France. The Commission thought it wise to extend the investigation to this firm's photocopier assembly operation and opened a new investigation in May 1989.
