(8)In order to ensure consistency with existing Union legislation in the area of financial services as well as the greatest possible level of financial stability across the spectrum of institutions, the resolution regime should not only apply to credit institutions but also to investment firms subject to the prudential requirements laid down by Directive 2006/49/EC of the European Parliament and of the Council of 14 June 2006 on the capital adequacy of investment firms and credit institutions The regime should also apply to financial holding companies, mixed financial holding companies provided for inDirective 2002/87/EC of the European Parliament and of the Council of 16 December 2002 on the supplementary supervision of credit institutions, insurance undertakings and investment firms in a financial conglomerateand amending Council Directives 73/239/EEC, 79/267/EEC, 92/49/EEC, 92/96/EEC, 93/6/EEC and 93/22/EEC, and Directives 98/78/EC and 2000/12/EC of the European Parliament and of the Councilmixed-activity holding companies and financial institutions, when the latter are subsidiaries of a credit institution or an investment firm.The crisis has demonstrated that the insolvency of an entity affiliated to a group can rapidly impact the solvency of the whole group and, thus, even have its own systemic implications.

Il devrait aussi s'appliquer aux compagnies financières holdings, aux compagnies financières holding mixtes visées par la directive 2002/87/CE du Parlement européen et du Conseil du 16 décembre 2002 relative à la surveillance complémentaire des établissements de crédit, des entreprises d'assurance et des entreprises d'investissement appartenant à un conglomérat financier et modifiant les directives 77/91/CEE et 82/891/CE du Conseil ainsi que les directives 2001/24/CE, 2004/25/CE, 2005/56/CE, 2007/36/CE et 2011/35/CE et le règlement (UE) n° 1093/2010 du Parlement européen et du Conseil, ainsi qu'aux compagnies holdings mixtes et aux établissements financiers, lorsque ceux-ci sont des filiales d'un établissement de crédit ou d'une entreprise d'investissement. La crise a montré que l'insolvabilité d'une entité affiliée à un groupe pouvait rapidement compromettre la solvabilité de l'ensemble du groupe et ainsi avoir elle-même des implications systémiques.
