In accordance with Article 10(1)(c) of Regulation (EU) No 1151/2012 the opponent alleged that the registration of ‘Liliputas’ as a Protected Geographical Indication would jeopardise the existence of a partly identical name, of trade marks and of products which have been legally on the Polish market for significantly more than five years preceding the date the application for registration of the name ‘Liliputas’ as Protected Geographical Indication was published in the Official Journal of the European Union (15 June 2013); according to the opponent, that registration would be a threat to the existence of the product named ‘Liliput’, which is a Polish cheese having characteristics similar to ‘Liliputas’ cheese and whose name is phonetically similar to the name ‘Liliputas’.

2) It was acknowledged that a mistake occurred in the preamble to the English language version of the codification proposal, in which the indication "(2)" erroneously appears as a recital number preceding another indication that should have appeared in a reference box. If, however, when a textile product is offered for sale or is sold to the consumer as referred to in the first subparagraph, a trade mark or a name of an undertaking is indicated which contains, on its own or as an adjective or as a root, one of the names listed in Annex I or a name liable to be confused therewith, the trade mark or the name of an undertaking must be immediately preceded or followed by the names, descriptions and particulars as to textile fibre content referred to in Articles 3 to 6 and in Annexes I and II in clear, legible and uniform print.

Amendment No 5 aims to remove the provision of not requiring the indication of the composition of compound ingredients used in small quantities – under 5% of the finished product – where the composition in question is covered by current Community legislation which gives the composition corresponding to the trade name.
