Definition: A heterogeneous group of disorders that share the characteristic of an onset in childhood but otherwise differ in many respects. Some of the conditions represent well-defined syndromes but others are no more than symptom complexes that need inclusion because of their frequency and association with psychosocial problems, and because they cannot be incorporated into other syndromes.

In order to placate certain Member States primarily concerned to demonstrate that the amending Treaty is not simply a Constitution by another name, a statement of the principle of the primacy of Union law over national law has regrettably not been retained in a prominent position in the Treaties, but is the subject of a declaration (Declaration No 17), which draws attention to the settled case law of the Court of Justice concerning the primacy of Union law and incorporates an opinion of the Council Legal Service which states that this principle is a cornerstone principle of Community law and that the fact that the principle of primacy will not be included in the future Treaty ‘shall not in any way change the existence of the principle and the existing case law of the Court of Justice’.

Where a device incorporates, as an integral part, a human blood derivative, the notified body shall, having verified the usefulness of the substance as part of the device and taking account of the intended purpose of the device, seek a scientific opinion from the EMEA, acting particularly through its committee, on the quality and safety of the substance, including the clinical benefit/risk profile of the incorporation of the human blood derivative into the device.

For the substances referred to in the first paragraph, the notified body shall, having verified the usefulness of the substance as part of the medical device and taking account of the intended purpose of the device, seek a scientific opinion from one of the competent authorities designated by the Member States or the European Medicines Agency (EMEA) acting particularly through its committee in accordance with Regulation (EC) No 726/2004 on the quality and safety of the substance including the clinical benefit/risk profile of the incorporation of the substance into the device.

In this report, which I had the honour of drafting, in accordance with the Hughes procedure, in cooperation with the Committee on Culture, Youth, Education, the Media and Sport and incorporating the opinions of the Committee on Women’s Rights and Equal Opportunities and the Committee of the Regions, which proved to be important and valuable contributions – I would highlight various measures intended to promote occupational and geographical mobility and the elimination of obstacles to their full realisation, some of which I shall now discuss.

Calls on the Commission, with a view to the rational management of fisheries, to define and adopt methods of analysing marine ecosystems based on the precautionary principle; and calls for TACs to be set in line with rational, transparent methods, incorporating scientific opinions and information provided by people working in the industry, particularly in view of the fact that TACs will be set on a multiannual and multi-species basis;

Points out that the protection of marine biotopes and the conservation of fisheries resources in ways that will ensure the sustainable development and rational exploitation of fisheries in line with the principle of economic efficiency, as well as maintenance of coherence with the marine environment, are principles which must govern the common fisheries policy; calls on the Commission, with a view to the rational management of fisheries, to define and adopt methods of analysing marine ecosystems based on the precautionary principle ; and calls for TACs to be set in line with rational, transparent methods, incorporating scientific opinions and information provided by people working in the industry, particularly in view of the fact that TACs will be set on a multiannual and multi-species basis, and calls for any upward or downward variation of more than 20% from one year to the next to be preceded by a socio-economic impact report, except in the case of a crisis caused by a collapse in the resource;

4. Except for medical devices using starting materials for which a TSE certificate has been issued as referred to in paragraph 3, national bodies shall, through their competent authority, seek the opinion of the competent authorities of the other Member States on their evaluation of and conclusions on the risk analysis and risk management of the tissues or the derivatives intended to be incorporated in the medical device as established by the manufacturer.
4.
