This Regulation introduces a common approach to ensuring that users of public mobile communications networks when travelling within the Community do not pay excessive prices for Community-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.
Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l’intérieur de la Communauté ne paient pas un prix excessif pour les services d’itinérance communautaire, par comparaison avec les prix nationaux concurrentiels, lorsqu’ils passent et reçoivent des appels, envoient et reçoivent des SMS et utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en favorisant la concurrence et la transparence sur le marché et en offrant à la fois des incitations à l’innovation et un choix aux consommateurs.

(3) Where a development incentive has been authorized in respect of a facility, the Minister shall not approve any capital costs of that facility that are in excess of 115 per cent of the capital costs that were forecast by the applicant at the time the Minister authorized the development incentive unless the applicant, before incurring such excess capital costs, obtained the agreement of the Minister to include such excess capital costs in determining the amount of the approved capital costs.

If a person, with respect to a member of the Canadian Forces referred to in section 1, received an amount representing death benefits or allowances under the Canadian Forces Superannuation Act that was in excess of the amount that would have been paid had the incentive pay of that member been calculated in accordance with the Canadian Forces Administrative Order governing transfers to pilot military occupation, remission of the amount of the excess payment is hereby granted to that person, including any interest payable on it.

If a member of the Canadian Forces was reclassified from the general service officer military classification to the pilot classification during the period beginning on December 1, 1977 and ending on December 31, 1994 and as a result of that classification received an amount representing pay and allowances and, in certain cases, annuities or other benefits under the Canadian Forces Superannuation Act that was in excess of the amount that would have been paid had the incentive pay of that member been calculated in accordance with the Canadian Forces Administrative Order governing transfers to the pilot military occupation, remission of the amount of the excess payment is hereby granted to that member, including any interest payable on it.
