Member States should therefore take appropriate ex ante or ex post regulatory measures (such as action to amend existing rights, to prohibit certain acquisitions of rights of use of spectrum, to impose conditions on spectrum hoarding and efficient use such as those referred to in Directive 2002/21/EC, to limit the amount of spectrum available for each undertaking, or to avoid excessive accumulation of rights of use of spectrum) to avoid distortions of competition in line with the principles underpinning Directive 2002/20/EC and Council Directive 87/372/EEC of 25 June 1987 on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community (8) (the ‘GSM’ Directive).

Member States should therefore conduct a thorough analysis of competition effects prior to new spectrum allocations, as well as taking appropriate ex ante or ex post regulatory measures (such as action to amend existing rights, to prohibit certain acquisitions of spectrum rights, to impose conditions on spectrum hoarding and efficient use such as those referred to in Article 9(7) of the Directive 2002/21/EC, to limit the amount of spectrum for each operator, or to avoid excessive accumulation of spectrum) to avoid distortions of competition in line with the principles underpinning Article 5(6) of Directive 2002/20/EC and Article 1(2) of Council Directive 87/372/EEC of 25 June 1987 on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community (the ‘GSM Directive’).

In view of the development and establishment of a pan-European eGovernment service and the underlying interoperable telematic networks, the possibility of establishing an electronic system for the exchange of information between Product Contact Points should be envisaged, in accordance with Decision 2004/387/EC of the European Parliament and of the Council of 21 April 2004 on the interoperable delivery of pan-European eGovernment services to public administrations, businesses and citizens (IDABC) (12).

In the Report, the Commission states that Member States and supervisory authorities are expected to make all reasonable efforts to create an environment in which data controllers (especially those operating on a pan-European and/or international level) can conform to their obligations in a less complex and burdensome way and to avoid imposing requirements that could be dropped without any detrimental effects.

Z. Even after accession of the EU to the ECHR, the European Court of Justice would remain the court of last instance for Community law. Its relationship with the European Court of Human Rights would be exactly the same as that of national supreme or constitutional courts which recognise the role of the European Court of Human Rights to verify consistency and compatibility with pan-European human rights norms. The European Union, once endowed with international legal personality, would be represented directly at the Court of Human Rights, thereby strengthening the authority and autonomy of both the European Court of Justice and the European Court of Human Rights;
