The detailed rules laid down in this Regulation replace those laid down in Commission Regulations (EEC) No 784/68 of 26 June 1968 laying down detailed rules for calculating cif prices for white sugar and raw sugar , (EEC) No 785/68 of 26 June 1968 determining the standard quality and laying down detailed rules for calculating the cif price for molasses , (EC) No 1422/95 , (EC) No 1423/95 of 23 June 1995 laying down detailed implementing rules for the import of products in the sugar sector other than molasses , (EC) No 1464/95 of 27 June 1995 on special detailed rules for the application of the system of import and export licences in the sugar sector and (EC) No 2135/95 of 7 September 1995 laying down detailed rules of application for the grant of export refunds in the sugar sector .

2. For the purposes of this Regulation, representative prices for molasses on the world market or on the Community import market as referred to Article 27(2) of Regulation (EC) No 318/2006 shall mean the cif prices for those products determined by the Commission in accordance with Section 2, hereinafter referred to as ‘molasses representative prices’.
2. Aux fins de l'application du présent règlement, on entend par prix représentatifs pour les mélasses sur le marché mondial ou sur le marché d'importation communautaire visés à l'article 27, paragraphe 2, du règlement (CE) no 318/2006, les prix caf pour ces produits déterminés par la Commission conformément à la section 2, ci-après dénommés «prix représentatifs pour les mélasses».

2. For the purposes of this Regulation, representative prices for white sugar and raw sugar on the world market or on the Community import market as referred to in Article 27(2) of Regulation (EC) No 318/2006 shall mean the cif prices for those products established under Section 1, hereinafter referred to as ‘sugar representative prices’.

Aux fins de l'application du présent règlement, on entend par prix représentatifs pour le sucre blanc et le sucre brut sur le marché mondial ou sur le marché d'importation communautaire visés à l'article 27, paragraphe 2, du règlement (CE) no 318/2006 les prix caf pour ces produits établis conformément à la section 1, ci-après dénommés «prix représentatifs pour le sucre».

Also, in accordance with Article 2(11) and (12) of the basic Regulation, a comparison of the normal value, as previously established (see recital 98), and the export prices of the company to the Union during the RP, expressed as a percentage of the CIF price at the Union frontier duty unpaid, showed significant dumping by the company in question with regard to the imports of the product under investigation.
Par ailleurs, conformément à l’article 2, paragraphes 11 et 12, du règlement de base, une comparaison entre la valeur normale établie précédemment (voir le considérant 98) et les prix à l’exportation pratiqués par la société à destination de l’Union durant la PR, exprimée en pourcentage du prix caf frontière de l’Union avant dédouanement, a mis en évidence un dumping notable de la part de la société en question sur les importations du produit soumis à l’enquête.

With regard to the effect of the dumped imports on prices, consideration shall be given to whether there has been significant price undercutting by the dumped imports as compared with the price of a like product of the Community industry, or whether the effect of such imports is otherwise to depress prices to a significant degree or prevent price increases, which would otherwise have occurred, to a significant degree.
En ce qui concerne l'effet des importations faisant l'objet d'un dumping sur les prix, on examinera s'il y a eu, pour les importations faisant l'objet d'un dumping, sous-cotation notable du prix par rapport au prix d'un produit similaire de l'industrie communautaire ou si ces importations ont, d'une autre manière, pour effet de déprimer sensiblement les prix ou d'empêcher dans une mesure notable des hausses de prix qui, sans cela, se seraient produites.

As suggested in recitals 83 and 89 of the provisional Regulation, the conditions of competition between the imported products regarding the likeness of the product and the similarity of the exporters’ behaviour (i.e. the significance of the import volume level, the development and level of the price of imports and their undercutting of prices of the Community industry and the similarity of sales channels) were analysed.
Comme indiqué aux considérants 83 et 89 du règlement provisoire, les conditions de concurrence entre les produits importés pour ce qui est de la similitude du produit et de l’analogie du comportement des exportateurs (autrement dit l’importance du volume des importations, l’évolution et le niveau du prix des importations et leur sous-cotation des prix de l’industrie communautaire ainsi que la similarité des circuits de vente) ont été analysées.

2. Where the cif price of white or raw sugar is higher than the intervention price plus 10 %, the Council may decide, acting on a proposal from the Commission in accordance with the voting procedure laid down in Article 37(2) of the Treaty, to grant an import subsidy for the product in question.
2. Lorsque le prix caf du sucre blanc ou du sucre brut est supérieur au prix d'intervention majoré de 10 %, le Conseil, statuant sur proposition de la Commission, selon la procédure de vote prévue à l'article 37, paragraphe 2, du traité, peut décider d'accorder une subvention à l'importation du produit considéré.

2. Where the cif price of white or raw sugar is greater than the intervention price plus an amount equal to the sum of 10 % of the intervention price and the storage levy applicable during the marketing year concerned, the Council, acting on a proposal from the Commission in accordance with the voting procedure laid down in Article 43 (2) of the Treaty, may decide to grant an import subsidy for the product in question.
2. Lorsque le prix caf du sucre blanc ou du sucre brut est supérieur au prix d'intervention majoré d'un montant égal à la somme de 10 % du prix d'intervention et de la cotisation de stockage applicable au cours de la campagne de commercialisation en cause. Le Conseil, statuant sur proposition de la Commission selon la procédure de vote prévue à l'article 43 paragraphe 2 du traité, peut décider d'accorder une subvention à l'importation du produit considéré.
