Over the past years, Hungary adopted several laws – some of them so-called cardinal laws adopted directly under its new constitution – which raised important fundamental rights concerns and also came under the scrutiny of the Council of Europe.

The Charter of Fundamental Rights of the European Union enshrines many rights of crucial importance to the integration process, including the freedoms of speech and religion, as well as the rights to equality and non-discrimination.Understanding and subscribing to these fundamental values is an essential element of living and participating in the host society At the same time, these rights also protect the third country national and foster his or her inclusion into society.In this vein, the Council discussed the integration of third country nationals in the context of its2016 Annual Dialogue on the Rule of Law which reaffirmed the importance of being guided by fundamental values, as well as the centrality of the principle of a two-way process on integration.
La Charte des droits fondamentaux de l’Union européenne consacre de nombreux droits revêtant une importance déterminante pour le processus d’intégration, dont les libertés d’expression et de religion, ainsi que les droits à l’égalité et à la non-discrimination. Comprendre ces valeurs fondamentales et y souscrire est un élément essentiel de la vie et de la participation à la société d’accueil. Réciproquement, ces droits protègent les ressortissants de pays tiers et favorisent leur inclusion dans la société.Dans cet esprit, le Conseil s’est penché sur l’intégration des ressortissants de pays tiers dans le cadre de son dialogue annuel 2016 sur l’État de droit, lors duquel a été réaffirmée l’importance de s’appuyer sur les valeurs fondamentales et d’envisager l’intégration comme un processus réciproque.

This Communication focuses on EU policy on the return of irregular migrants, which — together with efficient border management, effective sanctions against employers of irregularly staying third-country nationals, and the fight against smuggling and trafficking of human beings — is an important tool for facing the challenge of irregular migration, while fully ensuring respect for the fundamental rights and dignity of the individuals concerned, in line with the EU Charter of Fundamental Rights, the European Convention on Human Rights and all other relevant international human rights conventions.
La présente communication est axée sur la politique de l’Union européenne relative au retour des migrants en situation irrégulière, qui — associée à une gestion efficace des frontières, à des sanctions efficaces à l’encontre des employeurs de ressortissants de pays tiers en séjour irrégulier ainsi qu'à la lutte contre le trafic de migrants et la traite des êtres humains — est un instrument important dans la lutte contre l'immigration clandestine, qui garantit pleinement le respect des droits fondamentaux et de la dignité des personnes concernées, conformément à la charte des droits fondamentaux de l'Union européenne, à la convention européenne des droits de l’homme et à toutes les autres conventions internationales pertinentes en matière de droits de l’homme.

Welcomes the Commission Communication on the Strategy for the effective implementation of the Charter of Fundamental Rights by the European Union referring among others to its preventing approach in the effective implementation, the importance of internal training on fundamental rights, the systematic check of the fundamental rights aspect of the Commission's impact assessments by the Impact Assessment Board, as well as the targeted communication measures tailored to various situations needed in this respect; furthermore welcomes the emphasis of the above-mentioned Commission Communication regarding the importance of the political criteria for accession laid down by the 1993 Copenhagen European Council requiring candidate countries to have stable institutions guaranteeing democracy, the rule of law, human rights and respect for and protection of minorities; the preservation of this criterion is supporting the protection of fundamental rights in the future Member States;
se félicite de la communication de la Commission sur la stratégie pour la mise en œuvre effective de la Charte des droits fondamentaux par l'Union européenne, qui fait notamment référence à son approche préventive dans le cadre de la mise en œuvre effective, à l'importance des actions de formation interne sur les droits fondamentaux, à la vérification systématique, par le Comité d’analyse d’impact, des aspects relatifs aux droits fondamentaux dans les analyses d’impact de la Commission, et aux actions de communication ciblée et adaptée aux différentes situations nécessaire dans ce domaine; se félicite également de l'accent que met la Commission dans sa communication susmentionnée sur l'importance des critères politiques pour l'adhésion établis par le Conseil européen de Copenhague en 1993, qui demandent que les pays candidats présentent des institutions stables garantissant la démocratie, la primauté du droit, les droits de l'homme, ainsi que le respect des minorités et leur protection; est d'avis que la préservation de ce critère favorise la protection des droits fondamentaux dans les futurs États membres;

Expects concrete actions by the new Commissioner responsible, in line with already declared intentions: particularly and most importantly, welcomes the commitment to introduce a fundamental-rights impact assessment of all new legislative proposals; to oversee the legislative process to ensure that emerging final texts comply with the Charter; to apply a ‘zero tolerance’ policy on violations of the Charter, conducting in-depth investigations and initiating infringement procedures when Member States are in breach of their human rights obligations in implementing EU law; and to make sure EU citizens are properly informed on the new fundamental-rights architecture; calls for follow-up to the 2003 Communication on Article 7 of the Treaty on European Union (COM(2003)0606) to define a transparent and coherent way to address possible violations of human rights and make relevant use of Article 7 TEU on the basis of the new fundamental-rights architecture;
attend des actions plus concrètes du commissaire compétent, conformément aux intentions déjà déclarées: en particulier, et avant toute chose, se félicite de l'engagement à mettre en place une étude d’impact sur les droits fondamentaux de toute nouvelle proposition législative; à surveiller le processus législatif pour faire en sorte que le texte final soit conforme à la Charte; à appliquer une politique de «tolérance zéro» en ce qui concerne les manquements à la Charte, à mener des enquêtes approfondies et à lancer des procédures d’infraction lorsque les États membres ne satisfont pas aux obligations qui leur incombent en matière de droits de l'homme dans le cadre de la mise en œuvre de la législation européenne, et garantir que les citoyens de l'Union européenne sont correctement informés de la nouvelle architecture des droits fondamentaux; demande qu'il soit donné suite à la communication de 2003 sur l'article 7 du traité sur l'Union européenne (COM(2003)0606) qui demandait de définir un moyen transparent et cohérent de réagir aux éventuelles violations des droits de l'homme et d'utiliser de façon pertinente cet article 7 au vu de la nouvelle architecture de l'Union dans le domaine des droits fondamentaux;

Emphasises the importance of the judiciary bodies in the Member States, which play a primary role in ensuring compliance and the enforcement of fundamental rights, and therefore urges supporting easy access to the courts and proceedings with a reasonable time limit as a means of strengthening the protection of fundamental and human rights; urges the Member States to invest effort in the ongoing training of national judges on fundamental rights and freedoms, including the new aspects in the field after the Treaty of Lisbon;
souligne l’importance des organes judiciaires des États membres qui jouent un rôle primordial dans la réalisation des droits de l’homme et demande instamment que l'on promeuve un accès facile aux tribunaux et des procédures dans un délai raisonnable, pour assurer la protection des droits fondamentaux et des droits de l’homme; demande instamment aux États membres d’assurer la formation permanente des magistrats nationaux dans le domaine des droits et des libertés fondamentaux, y compris les nouveaux aspects relevant de ce domaine, à la suite de l'entrée en vigueur du traité de Lisbonne;

Recognising the important role of civil society in the protection of fundamental rights, the Agency should promote dialogue with civil society and work closely with non-governmental organisations and with institutions of civil society active in the field of fundamental rights.
Consciente du rôle important de la société civile dans la protection des droits fondamentaux, l'Agence devrait favoriser le dialogue avec la société civile et travailler en coopération étroite avec des organisations non gouvernementales et des institutions de la société civile intervenant dans le domaine des droits fondamentaux.
