On 14 April 2005, the Justice and Home Affairs Council called on the Commission to put forward, before the end of May 2005, a proposal on the establishment of an information system linking those responsible for immigration and asylum policy in the Member States so that they would be notified of important decisions to be taken by one or more Member States.
Le Conseil des ministres de la justice et des affaires intérieures du 14 avril dernier a demandé à la Commission européenne de présenter, avant la fin du mois de mai 2005, une proposition en vue de l’établissement d’un système d’information entre les responsables nationaux des politiques de l’immigration et de l’asile en ce qui concerne les décisions importantes devant être prises par un ou plusieurs États membres.

This report calls on Member States to give their neighbours and other EU Member States early warning, and we have tabled an amendment to paragraph 29 to make explicit reference to the need for information on the introduction of restrictive immigration measures to be exchanged and notified within the European Union, in other words not just such measures as mass regularisations, but also the opposite: if restrictive action is taken, that information should be shared within Europe.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.

- adopting at the earliest opportunity a joint action pursuant to Article K.3(2)(b) of the TEU, with a view to taking tough action to combat the traffic in children, not only in connection with the most serious forms of sexual exploitation, but also in connection with the adoption of children in other countries; such trafficking should, furthermore, be classified as an offence subject to the provisions of the criminal law of all Member States; each Member States should provide for the criminal or civil liability of any moral persons involved, without prejudice to the liability of the natural persons also involved, and for the provisions of Directive 91/398 of 10 June 1991 on money laundering to be applied against such persons; each Member State should set up a specific administrative body at national and/or regional level with responsibility for combating the traffic in children and cooperating closely with the relevant national police, immigration and social security authorities and with the other accredited bodies set up in the other Member States; the latter must notify the others of all cases involving the disappearance of children which have been brought to their notice;
- adopte, dans les meilleurs délais, une action commune, sur la base de l'article K 3, par. 2 (alinéa b), du TUE, visant à lutter de façon rigoureuse contre le trafic d'enfants, non seulement lorsqu'il est lié aux cas plus graves d'exploitation sexuelle, mais aussi lorsqu'il vise à l'adoption de l'enfant dans un autre pays; le trafic devrait aussi être qualifié comme étant un "délit" punissable par les dispositions de droit pénal de tous les Etats membres; chaque Etat membre devrait en outre prévoir la responsabilité (criminelle ou civile) des personnes morales impliquées, sans préjudice de la responsabilité des personnes physiques également impliquées, ainsi que l'application à leur encontre de la directive 91/305 du 10 juin 1991 sur le blanchiment des capitaux; chaque Etat membre devrait veiller à créer une structure administrative spécifique au niveau national et/ou régional ayant la compétence pour combattre le trafic d'enfants et travaillant étroitement avec les autorités responsables nationales de police, d'immigration et de la sécurité sociale, ainsi qu'avec les autres structures homologues créées dans les autres Etats membres; ces dernières doivent informer les autres de tous les cas portés à leur connaissance d'enfants disparus;
