Whilst promoting better integration into the labour market of legal migrants, the Commission will step up action against illegal employment of third country nationals, inter alia through better enforcement and application of the Employers Sanctions Directive, which prohibits the employment of third-country nationals who have no right to stay in the EU.
Tout en encourageant une meilleure intégration au marché du travail des migrants en situation régulière, la Commission donnera une ampleur accrue à la lutte contre l'emploi illégal de ressortissants de pays tiers, notamment en faisant mieux respecter et appliquer la directive concernant les sanctions à l’encontre des employeurs, qui interdit le recrutement de ressortissants de pays tiers qui n'ont pas le droit de séjourner dans l'Union.

whereas migrant women taking low-skilled temporary jobs on the periphery of the labour market or jobs as domestic workers may be exposed to double discrimination since, in addition to the fact that they often work in poor, irregular – if not illegal – conditions, they are more likely to be mistreated or subjected to violence or sexual abuse; whereas, furthermore, they are often unaware of their rights, have restricted access to public services, have limited knowledge of the local language and are unable to form networks, and whereas those in illegal employment do not dare contact the authorities to request protection because they fear being returned to their home country,

As part of the implementation of the policy plan on legal migration, legislative proposals have been presented to harmonise the admission procedures, criteria and rights of certain categories of third-country nationals [63]. The 'EU Blue Card' for highly qualified migrants has become a reality [64]. The fight against illegal immigration has been stepped up through the adoption of the "Return Directive" and a Directive providing for sanctions against employers of illegally-staying third-country nationals [65].

Takes the view that the Member States are making efforts with a view to uncovering illegal employment, particularly in the areas of domestic work and family care, in which a great many female migrants are employed; takes the view that a new formula must be devised which will allow the families who employ them to find a legal solution which allows these workers to have social security cover;

It builds on earlier Commission initiatives, in particular the Communication on Migration and Development [1] and the Policy Plan on legal migration [2], in addition to the renewed efforts to fight illegal immigration [3], in particular by means of stronger action against illegal work and especially employers using illegal migrant workers.

These include reducing the employment gap between EU nationals and non-EU nationals, promoting full participation and employment for 2nd generation migrants, addressing the specific needs of immigrant women, fighting illegal immigration and transforming undeclared work into regular employment.
Les défis à relever concernent notamment la réduction des écarts en matière de taux d'emploi entre les ressortissants de l'UE et ceux des pays tiers, l'encouragement de la pleine participation et de l'emploi des migrants de deuxième génération, la nécessité de répondre aux besoins particuliers des femmes immigrées, la lutte contre l'immigration clandestine et la transformation du travail au noir en emploi déclaré.
