TRADUCTIONS EN CONTEXTE

EDF levelled three main criticisms at the arguments set out in that decision: (i) the decision ignored the lessons of the judgment of the General Court and failed to recognise the true nature of the recapitalisation of EDF carried out by the state; (ii) the decision was excessively formalistic in that it wrongly postulated the need for a business plan linked to the investment, whereas the recapitalisation was the fruit of a lengthy reflection process, as attested by many documents from that period; and (iii) the decision argued, without any demonstration, that no investor in a situation as close as possible to that of the state would have made a comparable investment, contrary to the information provided by EDF in support of its observations.

This proposition ignores the way the applicant put his case referred to at paragraph 41 of the judgment viz. ‘that it is in respect of the conditions attached to FAF provided to [the Republic of Cyprus] on 26 April 2013and the process by which they were required by the Commission and the ECB that caused the applicant damage for which it seeks compensation pursuant to Articles 268 and 340 TFEU’.

Such an interpretation does not only ignore the overall grounds for the judgment, but also the case-law of the Court of Justice on so-called ‘Golden Shares’.
