17. In accordance with section III, paragraph 19, point (i) of the IGC 2007 Mandate relating to a Protocol on services of general interest which will be annexed to the Treaties, invites the Commission to take initiatives to overcome the legal uncertainty regarding the status of services of general interest, notably the state aid and public procurement rules; welcomes the initiatives of the Commission which aim to clarify ambiguities in the fields of health services and social services of general interest in the Single Market; considers that strong and modern services of general interest are necessary in order to achieve public interest objectives, such as social and territorial cohesion, environmental protection and cultural diversity;
17. conformément à la section III, paragraphe 19, point i) du mandat de la CIG de 2007 concernant un protocole sur les services d'intérêt général qui sera annexé aux traités, invite la Commission à prendre des initiatives en vue de remédier à l'incertitude juridique concernant le statut des services d'intérêt général, notamment les règles relatives aux aides d'État et aux marchés publics; se félicite des initiatives de la Commission visant à lever les ambiguïtés dans les domaines des services de santé et des services sociaux d'intérêt général dans le marché unique; estime que des services d'intérêt général modernes et puissants sont indispensables pour réaliser les objectifs d'intérêt public que sont notamment la cohésion sociale et territoriale, la protection de l'environnement et la diversité culturelle;

2. Takes note of the mandate for the IGC which was agreed by the European Council; welcomes its elaborate precision and the tight timetable for the conclusion of the IGC, and calls on the Member States not to retreat from the commitments to which they subscribed in the European Council; expresses a favourable opinion on the convening of the IGC;

Accordingly, the wish expressed by most governments to have what they describe as a genuine IGC, is therefore fully justified. They are calling for an IGC where meaningful discussion takes place, and where the original mandate is addressed.

The Helsinki European Council (December 1999) reaffirmed this mandate and decided that the IGC would look at the size and composition of the Commission, the weighting of votes in the Council, the extension of qualified-majority voting, as well as any other institutional adjustments that would have to be made to the Treaties in connection with the above issues and in the context of implementing the Treaty of Amsterdam.

Because, apart from the three institutional questions, which are already part of the IGC’s mandate, nobody in the context of the Amsterdam assessment has been able to tell us if the solutions that we had arrived at concerning the operation of this strengthened cooperation were satisfactory.
