J. whereas on 30 January 2015 the ICTY upheld the sentences of five high-ranking Bosnian Serb army officers convicted for their involvement in the 1995 Srebrenica genocide; whereas some of the convicted officers reported directly to former Bosnian Serb army leader Ratko Mladić, who is currently on trial at the ICTY for crimes including genocide;
J. considérant que le 30 janvier 2015, le TPIY a confirmé les condamnations de cinq officiers de haut rang de l'armée serbe de Bosnie en raison de leur participation au génocide de Srebrenica en 1995; que certains des officiers condamnés relevaient directement de l'ancien commandant-en-chef de l'armée serbe de Bosnie, Ratko Mladić, actuellement traduit devant le TPIY pour plusieurs crimes, dont le crime de génocide;

11. Recalls that full cooperation with ICTY is a fundamental condition for Serbia to progress on the path to EU membership; notes that Serbia continues to respond adequately to ICTY requests for assistance and calls on the Serbian Government to continue working closely with the Court, including swift transmission of all requested documents and timely completion of cases transferred back from ICTY; points out, however, the most recent assessment by the ICTY Chief Prosecutor that Serbia's efforts to apprehend the two remaining fugitives continue to be problematic; underlines that only apprehension and extradition of the fugitives to The Hague can be deemed the most convincing evidence of full cooperation and calls for more systematic efforts to arrest them so that the mandate of the Court can be finally fulfilled; in particular, urges a re-evaluation of the current approach, in line with the ICTY recommendations; emphasises that Serbia can only gain candidate status and/or open accession negotiations with the EU if the ICTY Office of the Prosecutor assesses that it has offered full cooperation;
11. rappelle qu'une coopération pleine et entière avec le TPIY est une condition essentielle pour que la Serbie progresse sur la voie de son adhésion à l'Union européenne; constate que la Serbie continue de répondre de manière appropriée aux demandes d'aide du TPIY et invite le gouvernement serbe à continuer de travailler étroitement avec le tribunal, notamment en transmettant sans délai tous les documents demandés et en concluant les affaires renvoyées du TPIY; attire toutefois l'attention sur la dernière évaluation du procureur général du TPIY qui indique que les efforts consentis par la Serbie pour appréhender les deux derniers fugitifs continuent de poser problème; souligne que seules l'arrestation et l'extradition des fugitifs vers La Haye peuvent être considérées comme les preuves les plus convaincantes d'une coopération pleine et entière et demande que des efforts plus systématiques soient déployés en vue de leur arrestation, de manière à ce que le mandat de la Cour puisse enfin être mené à bien; demande instamment, en particulier, qu'une réévaluation de l'approche actuelle soit menée, conformément aux recommandations du TPIY; souligne que la Serbie ne pourra obtenir le statut de candidat et/ou ouvrir des négociations d'adhésion avec l'Union que si le bureau du procureur du TPIY estime qu'elle a offert son entière coopération;

5. The Council calls upon Serbia to implement recommendations presented by the ICTY Office of the Prosecutor to the United Nations Security Council in June 2010 concerning Serbia’s support in ongoing trials and appeals and Serbia’s assistance in the key matter of the arrest of the two remaining fugitives, Ratko Mladic and Goran Hadzic, which would be the most convincing proof of Serbia's efforts and cooperation with the ICTY".
5. Le Conseil invite la Serbie à mettre en œuvre les recommandations présentées par le bureau du procureur du TPIY au Conseil de sécurité des Nations unies en juin 2010 concernant l'assistance de la Serbie pour les procès et les appels en cours ainsi que l'aide de ce pays sur la question cruciale de l'arrestation des deux derniers accusés en fuite, Ratko Mladić et Goran Hadžic, qui constituerait la preuve la plus convaincante des efforts fournis par la Serbie et de sa coopération avec le TPIY".

8. Welcomes the fact that Croatia is continuing to cooperate fully with the International Criminal Tribunal for the former Yugoslavia (ICTY); is concerned, however, about the negative impact which the judgments of the ICTY in the Vukovar war crimes cases has had on public opinion in Croatia; urges the Croatian government, with the support of all political parties, the media and civil society and jointly with the ICTY office in Croatia, to take steps to maintain popular support for the role of the ICTY in addressing the war crimes perpetrated during the Yugoslav conflict; notes that this support would be significantly strengthened if all the countries concerned were to cooperate fully with the ICTY;
8. se félicite que la Croatie continue de coopérer sans réserve avec le Tribunal pénal international pour l'ex-Yougoslavie (TPIY); se déclare, toutefois, préoccupé par l'impact négatif qu'ont eu, sur l'opinion publique croate, les arrêts rendus par le TPIY dans les affaires liées aux crimes de guerre de Vukovar; prie instamment le gouvernement croate, avec le soutien de l'ensemble des partis politiques, des médias et de la société civile d'engager une action conjointe avec le bureau du TPIY en Croatie, dans le but de préserver le soutien de la population au rôle du TPIY en ce qui concerne les crimes commis durant le conflit en Yougoslavie; observe que ce soutien serait considérablement renforcé si l'ensemble des pays concernés coopéraient sans réserve avec le TPIY;

In the context of Serbia’s application for membership of the European Union on 22 December 2009, the EU underlines that at each stage of Serbia’s path towards EU accession, following the decision referred to in paragraph 1, further steps will be taken when the Council unanimously decides that full co-operation with the ICTY exists or continues to exist. In this context, the Council will closely monitor the progress reports by the Office of the Prosecutor.
Dans le cadre de la demande d'adhésion à l'Union européenne présentée par la Serbie le 22 décembre 2009, l'UE insiste sur le fait que, à la suite de la décision visée au point 1, à chaque stade du processus d'adhésion de la Serbie à l'UE, de nouvelles mesures seront prises lorsque le Conseil conviendra, à l'unanimité, qu'il existe une coopération pleine et entière avec le TPIY ou que celle-ci se poursuit. À cet égard, le Conseil suivra attentivement les rapports du bureau du procureur sur l'état d'avancement de ce dossier.

As soon as the governments of Serbia and the FRY are under the political control of democratic forces, and as soon as all individuals indicted by the ICTY have been removed from Federal and Republican offices and the FRY fully cooperates with ICTY, as part of a general and determined effort to make a new beginning in the region, the EU undertakes to pursue the following objectives:

As a further step in the development of the EU's relations with the FRY, the Council today decided to reduce the restrictive measures against FRY to target: the former President of the FRY, Slobodan Milosevic, his family, four indictees of the International Criminal Tribunal for the Former Yugoslavia (ICTY) figuring in the same indictment as Slobodan Milosevic (Milutinovic, Sainovic, Ojdanic and Stoljilkovic) and three former JNA-officers indicted by the ICTY for atrocities against civilians in Vukovar (Mrksic, Radic, Slivancanin).
Afin de progresser sur la voie de la normalisation des relations de l'UE avec la RFY, le Conseil a décidé aujourd'hui de limiter les mesures restrictives décrétées à l'encontre de la RFY qui visent désormais essentiellement l'ancien président de la RFY, M.
