Joint Undertakings established in the Seventh Framework Programme under Article 187 TFEU for which further support may be provided under the above conditions are: the Innovative Medicines Initiative (IMI), Clean Sky, Single European Sky ATM Research (SESAR), the Fuel Cells and Hydrogen Joint Undertaking (FCH) and the Electronic Components and Systems for European Leadership Joint Technology Initiative (ECSEL).

(6) The Fuel Cells and Hydrogen Joint Undertaking, set up by Regulation (EC) No. 521(2008) of the Council of 30 May 2008 setting up the Fuel Cells and Hydrogen Joint Undertaking has demonstrated the potential of hydrogen as an energy carrier, and of fuel cells as energy converters, to offer a pathway for clean systems that reduce emissions, enhance energy security, and stimulate the economy.

The fuel cells and hydrogen 2 joint undertaking (FCH 2 JU) implements a public-private partnership (PPP) involving the European Commission, the fuel cell and hydrogen industry (represented by the NEW Industry Grouping) and the research community (represented by Research Grouping N.ERGHY).
L’entreprise commune Piles à combustible et Hydrogène 2 (ci-après l’«entreprise commune PCH 2») met en œuvre un partenariat public-privé (PPP) qui regroupe la Commission européenne, le secteur industriel des piles à combustible et de l’hydrogène (représenté par le groupement industriel NEW) et la communauté des chercheurs (représentée par le groupement scientifique N.ERGHY).

(10) Taking into account the public private partnership involving major stakeholders and its long term activity, the generated socio-economic benefits for European citizens, the pooling of financial resources and co-financing in the field of fuel cells and hydrogen RTDD activity provided by the Commission and industry, the high scientific and technical expertise required, and the input of industrial property rights, it is vital to set up a Fuel Cells and Hydrogen Joint Undertaking (hereinafter the "FCH Joint Undertaking") under Article 171 of the Treaty.
(10) Compte tenu du partenariat public-privé impliquant des partenaires de premier plan et son activité à long terme, des avantages socioéconomiques attendus pour la population européenne, de la mise en commun de ressources financières et du cofinancement dans le domaine des activités de RDTD dans le domaine des piles à combustible et de l'hydrogène assuré par la Commission et l'industrie, des compétences scientifiques et techniques de haut niveau exigées, et de la contribution des droits de propriété intellectuelle, il est vital d'instituer une entreprise commune Piles à combustible et Hydrogène (ci-après dénommée "l'Entreprise commune") en vertu de l'article 171 du traité.
