4. Welcomes the agreement between the Commission and the Hungarian Government to modify the Hungarian Media Law as requested. Welcomes the exceptionally fast decision of the Hungarian Government to modify the Media Law and welcomes the adoption of the modifications by the Hungarian Parliament in the upcoming days. Expresses disappointment that the Hungarian Socialist Party in the Hungarian Parliament opposed the urgency vote on the agreed amendments;

Declares that a resolution against the Hungarian Media Law has no justified reason any more; expresses therefore disappointment as to the manipulative and politically motivated comments often out of content on the Hungarian Media Law and the Hungarian Government, and considers that this unfounded criticism aims to weaken the Hungarian Presidency this way do harm to EU as a whole facing its biggest challenges since its creation;
6. affirme qu'une résolution contre la loi hongroise sur les médias ne se justifie plus; exprime par conséquent sa déception comme suite aux commentaires manipulateurs, politiquement biaisés et souvent hors contexte faits sur cette loi et sur le gouvernement hongrois et estime que ces critiques iniques visent à affaiblir la présidence hongroise et, par ce biais, à nuire à l'Union dans son ensemble au moment où elle est confrontée à ses plus grands défis depuis sa création;

Welcomes the Commission’s cooperation with the Hungarian authorities to bring Hungarian media law into conformity with EU Treaties and law, and the commencement of the amending process at national level;

whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,
considérant que l'OSCE a émis de sérieux doutes quant au champ d'application matériel et territorial des dispositions législatives hongroises, à la liberté d'expression et à la teneur de la législation, à la nomination d'une seule et même personne incarnant l'autorité nationale des médias et des télécommunications (4), à la diffusion des médias de service public, indiquant que la nouvelle législation compromet le pluralisme des médias, supprime l'indépendance politique et financière des médias de service public et grave dans le marbre des éléments négatifs pour la liberté des médias sur le long terme, et que l'Autorité des médias et le Conseil sont politiquement homogènes (5) et exercent un contrôle gouvernemental et politique centralisé et envahissant sur tous les médias; que d'autres inquiétudes sont soulevées, entre autres, par les sanctions disproportionnées et extrêmes infligées pour des raisons discutables et floues, l'absence d'une suspension automatique des sanctions en cas de recours en justice introduit contre une sanction prononcée par l'Autorité des médias, la violation du principe de confidentialité des sources journalistiques et la protection des valeurs de la famille,

whereas, in a second opinion issued on 25 February 2011, the Commissioner for Human Rights recommends a ‘wholesale review’ of the Hungarian media law package, with the objectives, inter alia, of reinstating precise legislation promoting a pluralistic and independent media, and strengthening the guarantees that media regulatory mechanisms will be immune from political influence (7); whereas he further states that the media in Hungary must be able to perform their role as watchdog in a pluralistic democratic society and that in order to achieve this, Hungary should abide by its commitments as a member state of the Council of Europe and make the most of that organisation’s expertise in the fields of freedom of expression and media independence and pluralism,
