whereas the Council of Europe Commissioner for Human Rights called on the Hungarian authorities, when reviewing the media law, to take account of Council of Europe standards on freedom of expression and media pluralism, the relevant recommendations of the Committee of Ministers and the Parliamentary Assembly of the Council of Europe, and, in particular, the binding standards set out in the ECHR and the case law of the European Court of Human Rights; whereas he referred to the use of unclear definitions which are open to misinterpretation, the establishment of politically unbalanced regulatory machinery with disproportionate powers which is not subject to full judicial supervision, threats to the independence of public-service broadcast media, and erosion of the protection of journalists’ sources; whereas he also stressed the need for all relevant stakeholders, including opposition parties and civil society, to be able to participate in a meaningful manner in the review of this legislation, which regulates such a fundamental aspect of the functioning of a democratic society (6),
considérant que le commissaire aux droits de l'homme du Conseil de l'Europe a demandé aux autorités hongroises de tenir compte, lors du réexamen de la législation sur les médias, des normes du Conseil de l'Europe sur la liberté d'expression et le pluralisme des médias, des recommandations pertinentes du Comité des ministres et de l'Assemblée parlementaire du Conseil de l'Europe, et notamment des normes contraignantes qui figurent dans la Convention européenne des droits de l’homme et la jurisprudence de la Cour européenne des droits de l'homme; qu'il a épinglé l'utilisation de définitions peu claires qui peuvent donner lieu à de mauvaises interprétations, la création d'un mécanisme de réglementation déséquilibré d'un point de vue politique et doté de pouvoirs disproportionnés, qui n'est pas soumis à un contrôle juridictionnel suffisant, des menaces pesant sur l’indépendance des médias audiovisuels de service public et l’érosion de la protection des sources utilisées par les journalistes; considérant que le commissaire a également souligné que tous les acteurs intéressés, y compris les partis d’opposition et la société civile, doivent être véritablement associés au réexamen des dispositions de cette législation, car elles régissent un aspect tout à fait fondamental du fonctionnement d’une société démocratique (6),

whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,
considérant que l'OSCE a émis de sérieux doutes quant au champ d'application matériel et territorial des dispositions législatives hongroises, à la liberté d'expression et à la teneur de la législation, à la nomination d'une seule et même personne incarnant l'autorité nationale des médias et des télécommunications (4), à la diffusion des médias de service public, indiquant que la nouvelle législation compromet le pluralisme des médias, supprime l'indépendance politique et financière des médias de service public et grave dans le marbre des éléments négatifs pour la liberté des médias sur le long terme, et que l'Autorité des médias et le Conseil sont politiquement homogènes (5) et exercent un contrôle gouvernemental et politique centralisé et envahissant sur tous les médias; que d'autres inquiétudes sont soulevées, entre autres, par les sanctions disproportionnées et extrêmes infligées pour des raisons discutables et floues, l'absence d'une suspension automatique des sanctions en cas de recours en justice introduit contre une sanction prononcée par l'Autorité des médias, la violation du principe de confidentialité des sources journalistiques et la protection des valeurs de la famille,
