Complementing the dialogue, the EU will continue and intensify co-operation projects related to human rights and good governance, including under the European Initiative for Democracy and Human Rights under which China has become a focus country in 2003.

Council Regulations 975/99 and 976/99, the legal bases for human rights and democratisation activities under Chapter B7-7 of Community budget ('the European Initiative for Democracy and Human Rights'), provide for three possible areas of intervention: protection of human rights; democratisation; and conflict prevention and dealing with conflict consequences in terms of human rights, in particular through support to civil society organisations but also international organisations.

whereas a Vietnamese lawyer and human rights activist, Lê Thu Hà, was arrested on 16 December 2015, at the same time as a prominent fellow human rights lawyer, Nguyễn Văn Đài, who was arrested for conducting propaganda against the state; whereas on 22 February 2016 human rights defender Trần Minh Nhật was attacked by a police officer at his home in Lâm Hà district, Lâm Đồng Province; whereas Trần Huỳnh Duy Thức, who was imprisoned in 2009 after a trial with no meaningful defence, received a sentence of 16 years followed by five years under house arrest; whereas there is serious concern for the deteriorating health of Buddhist dissident Thích Quảng Độ, who is currently under house arrest.

As a severe violation of human rights mentioned in the Charter of Fundamental Rights, trafficking in human beings will continue to be covered under the Human Rights Clauses in the EU's agreements with third countries, including the Free Trade Agreements, providing the basis for cooperation on and promotion of human rights[33].

13. Pointing out that the Association Councils generally govern EU/third country relations, calls for the general establishment of subcommittees on human rights under association agreements, with a mandate to review compliance with, and the application and implementation of, the democracy clause, and to propose specific positive actions to improve democracy and human rights; considers that such subcommittees should meet regularly (and in any case whenever the Association Council meets), and should include and consult representatives of parliaments and of organisations representing civil society; considers, in this regard, that a case-by-case policy is not the most adequate approach to be adopted with partner countries with regard to the setting-up of subcommittees on human rights and the definition of their mandate; stresses once again the need to deal with individual cases within those subcommittees;
13. en rappelant que les Conseils d'association régissent en règle générale les relations entre l'UE et les pays tiers, demande la mise en place généralisée, au titre des accords d'association, de sous-commissions des droits de l'homme chargées de vérifier le respect, l'application et la mise en œuvre de la "clause démocratique", de même que de proposer des actions positives spécifiques pour améliorer la démocratie et les droits de l'homme; estime que de telles sous-commissions devraient se réunir à intervalles réguliers (et de toute façon lorsque le Conseil d'association se réunit) ainsi que comprendre et consulter des représentants des parlements et des organisations de la société civile; estime à cet égard qu'une approche au cas par cas n'est pas la méthode la plus appropriée à adopter à l'égard des pays partenaires pour la mise en place de sous-commissions des droits de l'homme et la définition de leur mandat; souligne à nouveau la nécessité de traiter des cas individuels au sein de ces sous-commissions;

34. Recalls the case law of the European Court of Human Rights, which recognises economic and social rights as basic human rights under the terms of European Convention on Human Rights;
