Social, economic and cultural rights as human rights objectives are also promoted through the EC's development co-operation and external assistance programmes (see 3.2).

This Communication has identified three areas in which the Commission can play a more effective role in the pursuit of the EU's human rights and democratisation objectives: through the promotion of coherence and consistency across EU and EC policies; through placing a higher priority on, and 'mainstreaming', human rights and democratisation objectives in the European Union's relations with third countries, in particular through political dialogue and strategic use of its external assistance programmes; and through adopting a more focussed and strategic approach to the European Initiative for Democracy and Human Rights (EIDHR).

This is the case, inter alia, for democracy support, which is going to be mainstreamed across a number of objectives; for Economic, Social and Cultural rights; for addressing violation of human rights and international humanitarian law in crises and conflicts; for fighting discrimination, particularly against women, children, persons with disabilities and LGBTI but also against members of religious minorities; for fighting torture and ill-treatment and for increasing the coherence of EU policies from a Human Rights point of view.
C’est le cas, entre autres, du soutien à la démocratie, qui va être intégré dans plusieurs objectifs, des droits économiques, sociaux et culturels, des mesures à prendre face aux violations des droits de l’homme et du droit humanitaire international dans les situations de crise et de conflit, de la lutte contre la discrimination, à l’encontre notamment des femmes, des enfants, des personnes handicapées et des personnes LGBTI, mais également des membres de minorités religieuses, de la lutte contre la torture et les mauvais traitements, ainsi que du renforcement de la cohérence des politiques de l’UE du point de vue des droits de l’homme.

Furthermore, whilst democracy and human rights objectives must be increasingly mainstreamed in all instruments for financing external action, Union assistance under this Regulation should have a specific complementary and additional role by virtue of its global nature and its independence of action from the consent of the governments and public authorities of the third countries concerned.
En outre, alors qu'il est nécessaire de renforcer l'intégration des objectifs de démocratie et de droits de l'homme dans tous les instruments destinés à financer l'action extérieure, l'aide de l'Union fournie au titre du présent règlement devrait jouer un rôle spécifique complémentaire et supplémentaire en raison de son caractère international et du fait qu'elle peut être octroyée sans solliciter le consentement des gouvernements et des autorités publiques des pays tiers concernés.

The instrument hereby established is intended to contribute to achieving the objectives of the Union's external action, including those of its development policy, in particular the objectives set out in the Joint Statement by the Council and the representatives of the Governments of the Member States meeting within the Council, the European Parliament and the Commission on European Union Development Policy entitled ‘The European Consensus’ and in the Commission Communication of 13 October 2011 entitled ‘Increasing the Impact of EU Development Policy: an Agenda for Change’, and the Union's policies relating to human rights, including the objectives outlined in the EU Strategic Framework and Action Plan on Human Rights and Democracy, adopted by the Council on 25 June 2012.
L'instrument institué par le présent règlement a vocation à contribuer à la réalisation des objectifs de l'action extérieure de l'Union, notamment ceux de la politique de développement, en particulier les objectifs énoncés dans la déclaration conjointe de Conseil et des représentants des gouvernements des États membres réunis au sein du Conseil, du Parlement européen et de la Commission sur la politique de développement de l'Union européenne intitulée: «Le consensus européen» et dans la communication de la Commission du 13 octobre 2011 intitulée «Accroître l'impact de la politique de développement de l'UE: un programme pour le changement», et ceux des politiques de l'Union en matière de droits de l'homme, y compris les objectifs énoncés dans le cadre stratégique de l'UE et le plan d'action de l'UE en matière de droits de l'homme et de démocratie, adoptés par le Conseil le 25 juin 2012.

In order to address the above issues in an effective, transparent, timely and flexible manner beyond the expiry of Council Regulation (EC) No 975/1999 of 29 April 1999 laying down the requirements for the implementation of development cooperation operations which contribute to the general objective of developing and consolidating democracy and the rule of law and to that of respecting human rights and fundamental freedoms (9) and Council Regulation (EC) No 976/1999 of 29 April 1999 laying down the requirements for the implementation of Community operations, other than those of development cooperation, which, within the framework of Community cooperation policy, contribute to the general objective of developing and consolidating democracy and the rule of law and to that of respecting human rights and fundamental freedoms in third countries (10), which served as the legal base for the European Initiative for Democracy and Human Rights and which expire by 31 December 2006, there is a need for specific financial resources and a specific financing instrument that can continue to work in an independent manner whilst remaining complementary to and reinforcing related Community instruments for external assistance, the Partnership Agreement between the Members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part (11), and humanitarian aid.
En vue de trouver des réponses efficaces, transparentes, rapides et souples aux difficultés citées ci-avant au-delà de l'expiration, le 31 décembre 2006, du règlement (CE) no 975/1999 du Conseil du 29 avril 1999 fixant les exigences pour la mise en oeuvre des actions de coopération au développement qui contribuent à l'objectif général du développement et de la consolidation de la démocratie et de l'état de droit ainsi qu'à celui du respect des droits de l'homme et des libertés fondamentales (9) et du règlement (CE) no 976/1999 du Conseil du 29 avril 1999 fixant les exigences pour la mise en oeuvre des actions communautaires, autres que celles de coopération au développement, qui, dans le cadre de la politique de coopération communautaire, contribuent à l'objectif général du développement et de la consolidation de la démocratie et de l'état de droit ainsi qu'à celui du respect des droits de l'homme et des libertés fondamentales dans les pays tiers (10), qui ont servi de base juridique à l'initiative européenne pour la démocratie et les droits de l'homme, il faut des ressources financières spécifiques et un instrument financier spécifique qui peut continuer à fonctionner en toute indépendance tout en continuant à compléter et en renforçant à la fois les instruments communautaires connexes de l'aide extérieure, l'accord de partenariat entre les membres des États d'Afrique, des Caraïbes et du Pacifique, d'une part, et la Communauté européenne et ses États membres, d'autre part (11), et l'aide humanitaire.
