The Commission text does not - even in the Explanatory Memorandum - refer to, or take account of, the experience acquired by the Committee on Petitions and its contribution to examining relevant cases. The Committee on Petitions, which receives a significant number of petitions relating to recognition of qualifications (amounting to 4 to 5 % of the total number of petitions in recent years), has been in a position to establish borderline cases of horizontal directives failing to be transposed, or being transposed in an incomplete or imprecise way, into national law (with certain professions being subject, and certain professions not being subject, to the provisions), for which penalties have been imposed by the European Court of Justice.
