Where the Commission has not submitted observations or where the Commission is satisfied that any observations submitted have been duly taken into account, the Commission shall adopt a decision approving the amendments to the Partnership Agreement and the relevant programmes without undue delay and in any event ►C1 not later than three months after their submission by the Member State in accordance with paragraph 4. ◄

Where the amendments referred to in the first, second and third subparagraphs have a bearing on any supporting documents or contracts to be submitted, the related amendments to such documents or contracts shall also be allowed’.

On the expiry of 12 months from the date of its circulation by the Depositary as provided for in paragraph 6, an amendment to an Annex shall enter into force for those Parties which have not submitted a notification to the Depositary in accordance with paragraph 8, provided that, at that time, not more than one third of those which were Parties at the time of the adoption of the amendment have submitted such a notification.

6. On the expiry of 12 months from the date of its communication by the Depositary as provided for in paragraph 4 above an amendment to an annex shall become effective for those Parties which have not submitted a notification to the Depositary in accordance with the provisions of paragraph 5 above, provided that not more than one third of the Parties have submitted such a notification.

Given than any and every proposal to amend this provision will have to follow the co-decision procedure provided for by the Treaty, and that the Commission will always have the possibility of securing a re-examination of the provision by the two co-legislators by submitting appropriate and reasoned proposals, the amendment, while not being taken over explicitly, can be accepted in substance by deleting paragraph 2 of Article 27.
